Meaningful Meaningful Use - June 11, 2010

Quiz:
What does the term “meaningful use” mean?
a. Using something in a way that gives life purpose and leads to carefree days of glee.
b. It depends on your definition of the word “term.”
c. It is not mean. It is really nice.
d. A large number of rules created by the government to assess a practice’s use of electronic medical records so that they can spur adoption, give criteria for incentive rewards, and have physicians in a place where care can be measured.
e. Job security for those making money off of health IT.
The answer, of course is d and e.
Meaningful Use, in the eyes of many is seen as curse words, especially doctors.
Under the plan, physicians will be paid cash dollars for meeting these criteria. Here’s the payment:
•2011 – $18,000 per physician, one-time payment
•2012 – $12,000
•2013 – $8,000
•2014 – $4,000
•2015 – $2,000
•2016 – $0
•2017 – 1% penalty in Medicare payments if you do not qualify.
•2018 and beyond – 2% penalty. More criteria to qualify? More quality measures? More penalties for not meeting criteria? Stricter criteria for A1cs? Other insurance companies using the same criteria or different criteria? More government control is a definite.
So what’s the big deal? Why would doctors be against getting extra money? Here are some of the main reasons:
1.They don’t want to use EMR and feel like the government is forcing them
2.They think the rules are so onerous that it’s hopeless to even try
3.They only like yellow charts, and the blue ones make them feel depressed
4.They see that eventually non-adoption of EMR will be penalized. This makes many conclude that Meaningful Use is just a ploy for the government to cut reimbursement.
I too wish the chart was yellow, but overall I am not upset about all of this. The reason I am not upset is entirely selfish: I have been on EMR for 14 years and use a high-end product, so I will very likely be awarded the full $$ and avoid penalties. I also see this as an opportunity for physicians practicing good care to be seen as good doctors, and the bad ones to actually be penalized instead of rewarded.
You see, I have always seen EMR as much more than a computerized version of the paper chart. The true value in EMR is not that you get to type, it is that all of the information is stored in a single place, organized, and easily retrieved when needed. Using an EMR for documentation alone is like using a car to travel only as fast as you can walk. If payment is not so much based on the quality of my coding and my note-taking, but instead based on the quality of the care I give, isn’t that a good thing? Isn’t that what we should want?
No Patient Left Behind
The devil is in the details. Or, to be more accurate, the devil is in DC. The real problem with meaningful use is the fact that it is a mandate. Mandates like this – the use of testing/criteria by the government to get people to act in a certain way – have a huge flaw. This is best understood with another mandate of the government that has caused it’s own trouble: the No Child Left Behind law of 2001.
The intent of the NCLB law was to improve the quality of education in the US. It established standardized testing to:
1.Set a minimum requirement for education – students cannot be passed-on to higher grades unless they pass the test.
2.Held schools accountable for quality. Schools performing in the lowest range on the standardized testing would be publicly identified and penalized.
3.Teachers with low student scores would be penalized as well.
But the law of unintended consequences has caught up with NCLB, with schools/teachers “gaming” the system, undo focus on test-passage over comprehensive education, and squashing of teacher creativity with fear of low test-scores. Talking to teachers and parents (as a pediatrician), there is very little love for the NCLB law.
And children pay the price of this legislation as well. I saw a child recently who is a very hard worker, a very conscientious child, and who has been able to get mainly B’s in his classes. The problem for him is that he does not take standardized tests well. Despite medication and even allowances made in the testing setting, he fails the test which covers information he has shown in the classroom that he knows. The government calls his school and teacher as the cause of his failure, but he is the one who has to be held back until he’s able to pass the test.
In the same way, making a bunch of criteria for EMR use is sure to have a slew of unintended consequences. Doctors will select EMR systems based on meaningful use criteria, not on how well they work. Doctors will select patients who can get the scores higher and discharge those who probably need the most help.
Sounds familiar.
Meaningful Meaningful Use
What should be done? The real question should be: what can an EMR do to impact patient care that would be truly meaningful? If an EMR improves the ability of the doctor to take care of the patient, that is meaningful. But if the EMR makes the doctor pay more attention to qualifying for the cash payment than to the real care of the patient, it is more meaningless use.
I use an EMR every day. I use it because it helps me give better care and makes our office run more efficiently. If we have a new process that works better by using paper, we use paper. We are not wed to the idea of using computers, we are committed to good process and excellent care. The good news for us is that doing so has made us efficient enough to increase our revenue significantly at the same time that we improve our care quality. That’s what everyone wants.
It really worries me that the imposition of these criteria on EMR will dilute my focus on patients with a focus on achieving meaningful use. This is similar to the experience of many good teachers who had to abandon more creative teaching methods to ensure better test performance. If the criteria are not right, they will do this; there is no question.
So before imposing a set of criteria to be evaluated on doctors, we need to be sure that the criteria themselves are scrutinized. For them to truly improve care and not add more burdens to medical offices, they should:
•Improve doctor/patient communication
•Make information more accessible to doctors and patients
•Capture data automatically, not necessitating extra steps that could distract from care
•Capture data so it can be used for reminders and clinical decision-making at the point of care
•Improve doctor/doctor communication (primary care to specialists and hospitals)
•Capture interventions, not just outcomes. For example, the prescription of a blood pressure medication should be rewarded, not only if the patient takes it. The ordering of a mammogram should be rewarded, not just if the patient gets it done.
•Systems should be required to “close the loop” for interventions, meaning that ordering providers should be alerted to any test, procedure, or consult results that do not come back. This is an enormous problem that frustrates many doctors and patients, increases medical liability, and causes harm. Computers are good at this kind of thing.
I am sure there are more, but my word count is getting high. The bottom line: meaningful use has to be truly meaningful.

6 Myths Surrounding ARRA/HITECH EHR Incentives - June 11, 2010

In a time when hospitals and physicians are seeing declining reimbursements, the ARRA Medicare/Medicaid EHR Incentive Program is a rare opportunity to be eligible for substantial incentives. However, the road to attaining the incentives is complicated. Uncertainties related to the definition and documentation of meaningful use can translate to lost incentives or, even worse, penalties.
As the definitions governing “meaningful use of certified technology”continue to evolve, it is critical to develop a roadmap to help your organization comply with the moving target of rules regarding compliance and documentation and get your fair share of the incentives.
3 Myths of the Hospital Program
1) Hospitals must decide between the Medicare or Medicaid ARRA incentives: FALSE – “Eligible hospitals can qualify to receive payments from both the Medicare and Medicaid EHR incentive programs.”
2) Hospitals must meet all requirements by October 1st, 2010 to receive the 2011 incentives: FALSE – “CMS proposes that, for the first year an eligible hospital demonstrates meaningful EHR use, an EHR Reporting Period equals any 90 continuous days beginning and ending within the year.”
3) In 2011 hospitals must electronically transmit all Meaningful Use objectives to CMS. FALSE- “In 2011, all of the results for all objectives/measures, including clinical quality measures would be reported by EPs and hospitals to CMS, or for Medicaid EPs and hospitals to the states, through attestation.”
3 Myths of the EP Program
1) PAs and FNPs are eligible for both the Medicare and Medicaid ARRA incentives: FALSE- “A Medicare EP is a doctor of medicine or osteopathy, a doctor of dental surgery or dental medicine, a doctor of podiatric medicine, a doctor of optometry, or a chiropractor.” “EPs (Medicaid) are physicians, dentists, nurse practitioners, certified nurse midwives, and physician assistants practicing predominantly in a Federally Qualified Health Center or Rural Health Clinic (FQHC/RHC) that is directed by a physician assistant.”
2) Eligible Providers must meet all requirements by January 1st, 2011 to receive the 2011 Medicare incentives: FALSE – “For the first year an EP applies for and receives an incentive payment, CMS proposes that an EHR Reporting Period is 90 days for any continuous period beginning and ending within the year.”
3) Eligible Providers must meet all ARRA criteria in 2011 to receive the maximum Medicare incentives. FALSE – “In general, a qualifying EP can receive an annual incentive payment as high as $18,000 if their first payment year is 2011 or 2012.”

How to Evaluate That EHR Demo - June 11, 2010

Selecting an EHR is not just about the demo. But those EHR vendors sure do put a lot of focus on that demo! You need to get beyond the smoke and mirrors and consider how to use that focus to evaluate the solution as it meets your needs and requirements.
Before you even schedule any vendor demonstrations, write down your "must haves." Can you identify your top 10 requirements?
For example, in one practice I work with, the system must track all pap smears for outstanding results and also automate notification to the patients of their result. In another, the EHR must incorporate a point-of-sale purchase of retail items. A 10-physician internal medicine practice required that their EHR solution incorporate voice recognition software to ease the transition for keyboard-phobic physicians.
Different specialties have different needs, and you should think of as many specialty-specific requirements as possible. Having an interface to the lab results for the bulk of your patients (75% to 80%) is an absolute requirement in primary care, for instance. Try asking yourself: What do I do that doctors in other specialties don't? Figure out how those differences would translate to functions in the EHR.
You can also incorporate the criteria that CMS will use to define Meaningful Use of an EHR for its incentive program to determine how your use of the EHR system will address specific objectives. (Even though the criteria are only in the interim final rule stage, wholesale changes don't usually happen past that point.)
For example, it is likely that collecting the smoking status on all patients ages 13 and older will be one of the objectives, so ask the EHR vendor to show you how their solution prompts you and/or your staff to ask the patient, document the response, and then generate the collective data for reporting.
Articulating your needs and requirements is just the first step for effective evaluation of system demonstrations.
The second step is to use those needs to create a scoring tool to track and document the EHR demonstration against the needs.
Keep the scoring simple. A 3-2-1 system will do just fine. The vendor scores a "3" for a specific need if the system exceeds your requirement, a "2" for meeting your requirements and a "1" if the system does not meet your requirements. The higher the vendor's score, the better fit the system is for your practice.
How does the scoring tool help after you've viewed three or four demonstrations? You can approach the comparison several ways.
The most basic -- though not necessarily the best -- way is to look at the total score for each product. High score wins and that's the one you buy.
Or you can compare the vendors on each "need" individually. Clearly if a vendor scored a "1" on each element, that product is a no-go. That's probably unlikely, though, so you'll need to prioritize your "needs." Again, the product that has the highest scores on the most number of top-priority elements is your winner.
It may also help to have a "deal-breaker" need. If a vendor scores a "1" on that one item, even if his system has "2"s and "3"s on all the others, you might want to rule it out.
You may also decide to include some "nice-to-have" features on your list. If so, scores on those items may tip the scale for one product over another.
It is easy to get distracted during a demo by all the features and functions the company representative will show you. Many systems have polished user interfaces and many demonstration specialists have perfected their skill at showing off the sizzle in their system.
But if you begin the demo preparation with the end in mind -- by clearly articulating your objectives and vision for your EHR implementation -- you will identify the solution that will have the greatest opportunity for successful use in your practice.
Focus on how the solution meets your requirements, not on the man behind the screen as you travel down the road to your EHR selection.

Allscripts-Eclipsys Deal a "Significant Event" in EMR Market - June 10, 2010
A 'significant event' in the EMR market has occurred with the purchase of Atlanta-based Eclipsys by Allscripts, a Chicago-based company, according to healthcare market research publisher Kalorama Information. Kalorama has been publishing detailed studies on the $13.8 billion EMR market for the past four years, and sees this purchase as a plausible attempt to unite a market where currently, hospitals and physicians choose from a wide range of vendors.
"We talk in our study about how there was no clear market leader in EMR and that there was a window for new entrants to enter the market," said Bruce Carlson, Publisher of Kalorama Information. "This deal doesn't close that window, but perhaps the opening just got a little smaller."
According to media reports, the purchase will be conducted in an all-stock deal valued at about $1.3 billion. The combined company will have 5,500 employees. Allscripts CEO Glen Tullman will serve as CEO of the combined company, with Eclipsys' President and CEO Phil Pead taking the chairman's title.
Prior to the purchase, Allscripts was one of the better-recognized names in the physician EMR market, according to Kalorama's most recent report on the market, "EMR 2010 (Market Analysis, ARRA Incentives, Key Players, and Important Trends)," published earlier this year before the purchase was announced. The company ranked in the top three in name recognition surveys along with Epic and Centricity. The report also indicated that in the category of "physician office and web-based sales" of EMR software (excluding large hospital/health system sales), Allscripts was the number one company in the segment. Allscripts provides electronic health records software primarily to physicians' practices and post-acute organizations, and claims 180,000 physician clients. The Eclipsys purchase brings them nearly 1,500 hospital customers, which Kalorama sees as significant.
"It's logical to match these companies up since Allscripts has physicians and Eclipsys reaches into hospitals and health systems market," said Carlson. "Despite Allscript's name recognition in the physician market, it would have been hard for any company to maintain leadership in EMR without reaching into the hospital space as well. It's not easy to break into the hospital EMR market, so an acquisition was the logical play here."
The company still faces challenges including the blending of their software offerings and competition from McKesson, Cerner, and GE Healthcare, as well as Dell Microsystems which recently entered the EMR market. The EMR industry collectively faces the challenge of incorporating "meaningful use" guidelines into vendor offerings in a way that will encourage physicians to use EMR at greater rates than what we currently see.

Orlando Florida -- Allscripts-Misys Healthcare Solutions Inc. agreed to buy Eclipsys Corp. for $1.3 billion in stock, creating a software company that will allow U.S. doctors and hospitals to share patients’ records.
The acquisition values Atlanta-based Eclipsys at $22.10 a share, 19 percent above yesterday’s closing price on the Nasdaq Stock Market. Misys Plc, the U.K. company that owns 54.6 percent of Allscripts, will sell much of its stake to facilitate the transaction, Misys said in a statement. Misys rose the most since September 2008 in London trading after saying it will return most of the proceeds to shareholders.
U.S. health-care computing providers are looking to take advantage of laws in the U.S. that emphasize new technologies to reduce the costs of patient care. The combined company will have more than 180,000 U.S. doctors, 1,500 hospitals and almost 10,000 nursing homes as clients, the companies said in a statement today.
The combination “creates a ‘hub’ of large and well- respected hospitals that will accelerate connections” to physicians’ practices, Allscripts Chief Executive Officer Glen Tullman said in the statement. “We are at the beginning of what we believe will be the single fastest transformation of any industry in U.S. history.”
Allscripts specializes in information systems for doctors’ offices, while Eclipsys provides software to hospitals and health systems, the companies said. A U.S. law passed last year to boost the economy provides about $30 billion in federal funding for hospitals and doctors to adopt electronic health records, they said.

Tullman will be chief executive of the combined company. Philip Pead, Eclipsys’s president and CEO, will serve as chairman, working full-time on client and strategic relationships, the companies said. The board will initially include directors from both Eclipsys and Allscripts and the deal will close in about four to six months, they said.
Shareholders of Eclipsys, based in Atlanta, will receive 1.2 Allscripts shares for each Eclipsys share. The deal, which the companies described as a merger, values Eclipsys at about 30 times this year’s estimated earnings per share, according to Bloomberg data. U.S. medical-information technology companies on average sell for about 24 times this year’s expected earnings, the data show.
The purchase will add to Allscripts earnings in 2011, using a method that doesn’t meet generally accepted accounting principles, Allscripts said. Savings over the first three years after completion of the deal will total more than $100 million, the company said.
Shares Fall
Eclipsys fell 23 cents, or 1.2 percent, to close at $18.51 yesterday in Nasdaq Stock Market trading. The stock has risen 6.3 percent in the past year, compared with a 27 percent rise in the S&P 600 Health Care Index. Allscripts fell 25 cents, or 1.3 percent, to close at $18.42 yesterday in Nasdaq trading.
The sale by Misys ends an investment of less than two years in Allscripts. Shares of the U.S. company have more than tripled since October 2008, when Misys paid $330 million in cash to merge its health-care unit with Allscripts.
Misys will sell about 68 million Allscript shares through a secondary offering and via share repurchases by Allscripts, raising about $1.3 billion, the Evesham, U.K.-based provider of industry-specific software said. Misys plans to return about $1 billion to shareholders by starting a tender offer for stock, the company said.
‘Great Deal’
“It’s a great deal for Misys and their shareholders,” Roger Phillips, an analyst at Evolution Securities in London, said by phone. “They had been talking about the long-term future of the health-care business and now they’re selling out, but at an extremely good price.” He has a “neutral” recommendation on the stock.
Misys rose 44 pence, or 20 percent, to 267.5 pence at 9:10 a.m. in London. The stock gained as much as 26 percent, the biggest intraday advance since September 2008.
Investment bankers from UBS AG, Barclays Capital and JPMorgan Chase & Co. advised Allscripts on the deal, while Blackstone Group LP and William Blair & Co. were financial advisers to the Allscripts audit committee. UBMD Selects Allscripts Electronic Health Record - June 7, 2010

"The Allscripts electronic health record will let us develop a single, comprehensive patient record across multiple practices while still enabling our physicians in different specialties to refine and customize the type of information they enter and the way they work," said Michael Quinn, Chief Financial Officer of UBMD, a multispecialty group practice whose 450 physicians are faculty at the University at Buffalo School of Medicine and Biomedical Sciences.
UBMD physicians work in 18 practices across Western New York and also practice at affiliated institutions including Kaleida Health and Erie County Medical Center Corporation. The group will initially implement the Electronic Health Record for 35 physicians and intends to complete the roll out to its physician base within two years.
Streamlined experience for patients
Mr. Quinn continued, "Now each provider in our 18 practices will be able to see what's going on with the patient, which supports our effort to deliver one-stop shopping for patients by referring them to other UBMD providers. It's a streamlined experience for both patients and providers."
UBMD's Internal Medicine division has used the Allscripts Electronic Health Record successfully since 2004. But when UBMD went looking for an enterprise EHR for the full group, they formed a physician-led committee to conduct an exhaustive review of other products on the market.
Research capabilities were critical
"Because we're a research organization as well as a clinical practice, we needed an EHR that could collect, store and retrieve data to support an academic practice," said Peter Winkelstein, M.D., Chief Medical Informatics Officer of UBMD and Chief of the Division of Pediatrics at the Women and Children's Hospital of Buffalo. "Above all, we really needed a product that would be able to collect data coherently and report on it coherently, and Allscripts very rapidly emerged from the herd on that front."
To help with its research efforts, UBMD will deploy Allscripts Analytics, which enables automatic tracking of performance on financial and quality measures – for example, the percentage of all diabetic patients whose blood glucose levels are not controlled – and also provides proactive patient and population management.
Allscripts also satisfied UBMD's other criteria for an enterprise Electronic Health Record – the proven ability to build interfaces with hospital inpatient information systems, and a strong patient portal solution, Winkelstein said.

Starting in 2011, the Centers for Medicare & Medicaid Services (CMS) will provide a reimbursement incentive for physician and hospital providers who are successful in becoming “meaningful users” of an electronic health record (EHR). Starting in 2015, providers are expected to have adopted and be actively utilizing an EHR in compliance with the “meaningful use” definition or they will be subject to financial penalties under Medicare.
With so much attention and so many dollars tied to the meaningful use of EHR systems, an effective strategy is to provide more “meaningful” content (especially drug content) directly from the health record itself. Many systems allow for this functionality; however, the more important considerations are the quality of the drug database, appropriateness for all patient populations, and the ability to quickly and easily obtain the correct answer. Integrating or even linking to meaningful clinical information from your EHR can be an effective strategy to make your EHR more meaningful as well.

Just to make sure we are all turned to the same page in our Cliff Notes on Meaningful Use, today’s conversation is, “There is no “R” in ROI.”
Are you familiar with the Abilene paradox? It is a paradox in which a group of people collectively decide on a course of action that is counter to the preferences of any of the individuals in the group. It involves a common breakdown of group communication in which each member mistakenly believes that their own preferences are counter to the group’s and, therefore, does not raise objections.
I think it occurs more often than we think. Try to recall the last meeting you attended in which you really disagreed with something that was said. Chances are you knew some of the others in the meeting well enough to know they also disagreed. The reason you know they also disagreed is because you had discussed the topic. However, none of you raised your disagreement during the meeting. Why? Because you did not want to rock the boat.
It is similar to a pseudoconsensus. Pluralistic ignorance. These create a bystander effect—people are more likely to speak out about an issue when they are alone with someone than when others are present.
After further consideration I think we must consider the very real possibility that there is no ROI for Meaningful Use. I write this in all sincerity. Healthcare executives march in lock-step or group think to achieve the myth of finding an ROI for Meaningful Use. The ROI is healthcare’s quest for the Holy Grail, albeit without the Monty Python sound track. They cannot proceed without one, so they set the target, figure out what data will demonstrate that they have hit it, and disregard the reams of data that does not support the ROI.
What if the government came out with a standard stating all hospitals ought to buy, install, and use a fifty million dollar transplant device that also flosses the patient’s teeth? This initiative is “optional”, but the government will pay the hospital a two hundred thousand dollar rebate. There are several types of transplant flossers—the ones that deliver that fresh mint taste cost extra.
If we were having a business discussion about the ROI for the transplant device, healthcare executives would be foaming at the mouth about how impossible it would be to calculate an ROI, and rightly so. They would argue all hospitals are different, they have different cost structures, the devices are all different.
The standards for Meaningful Use are arbitrary. The standards were developed by people who do not need to meet an ROI. There was no mandate in the development of those standards to create standards which when met would yield an ROI. Any attempt to force an ROI will naturally differ in a number of ways:
•by provider—size, structure, offering, geography
•by their interpretation of Meaningful Use
•by which EHR they implemented
•when they began the implementation
•how well they implemented the EHR
Somebody somewhere may hit a positive ROI on Meaningful Use, just like somebody playing darts may hit a bull’s eye. Any positive ROI will be accomplished more out of chance, and from having fit the data to a predetermined ROI rather than measuring the ROI against its true impact.
Implementing an EHR can be very good for a hospital. However, it should be a business decision for the hospital based on the same set of business rules the hospital would use to justify any other large expenditure. If the hospital achieves an ROI it will not be because of having followed an arbitrary set of standards. Any ROI for an EHR will come from having done it correctly. Hitting the figure any other way means two things; it was a coincidence, or you are in for trouble down the road.
