How to Best Meet Meaningful Use under the HITECH Act - July 29, 2010

Orlando Florida -- Quality improvement initiatives in provider organizations often go bad when they are mandated from the top down, and not integrated into clinical workflow and compete with other priorities, asserts Chris Wood, M.D., a family physician and medical director for information services at Intermountain Healthcare in Salt Lake City.

That’s why Wood worries that the HITECH Act’s incentive payments for meaningful EHR use will result in providers documenting meaningful use, but not really becoming meaningful users. For instance, one meaningful use criteria requires 80 percent of patients to have at least one problem on their problem list. Intermountain, which started building its EHR in 1968, currently has 1.7 million patients in its records database, with 58 percent having at least one problem on their list.

Wood wasn’t thrilled with some colleagues’ suggestions on how to get to the 80 percent threshold--document that 22 percent don’t have a medical problem or mandate physicians to put a problem on the list. But is that really meaningful use? Wood doesn’t think so.

The answer, he says, is to use the capabilities of information systems and the data within them to build problem lists into clinician workflow and associate a problem with appropriate billing data, such as the CPT code. “Automation must improve productivity without damaging clinical workflow,” he said at the Institute for Health Technology Transformation’s Summer Health IT Summit in Denver.

Having some component of an EHR for four decades, Intermountain has a formidable data warehouse supporting its 23 hospitals and more than 140 clinics. Using that data has helped the organization implement “bottom up” quality initiatives created within the organization with hard numbers that show whether the initiative are working, Wood says.

For instance, a survey of Intermountain physicians in 1985 found 100 percent said antibiotics to prevent post-surgical infection were given at the right time, but data showed only 40 percent compliance. Knowing that, the hospital was able to raise the rate to 58 percent one year later and 96 percent by 1991.

In another example, Intermountain went against conventional wisdom and waited until the 39th week of gestation for elective pregnancy inducements. The result, because the cervix was more ready for delivery and the baby spent more time in the womb, was significantly fewer Cesarean sections and admissions into the neonatal intensive care unit. Billings for these services went down, but costs went down more.

So, to get real meaningful use out of an EHR, Wood advises selecting a system with customizable documentation tools and granular data capture capability, establishing a data warehouse, and creating clinical teams to work on specific high-risk initiatives. “Start planning now on how to get the juice from your investment in HITECH.”

HHS Fines Rite Aid $1 Million for HIPAA Privacy Rule Violations, Will You Be Next? - July 29, 2010

Orlando Florida -- Rite Aid to Pay $1 Million to Settle HIPAA Privacy Case


Rite Aid Corporation and its 40 affiliated entities have agreed to pay $1 million to settle potential violations of the HIPAA Privacy Rule, HHS announced. Rite Aid, one of the nation's largest drug store chains, agreed to take corrective action to safeguard the privacy of its customers when disposing of identifying information on pill bottle labels and other health information.

Rite Aid came under scrutiny after television reporters videotaped incidents in which pharmacies were shown to have disposed of prescriptions and labeled pill bottles containing individuals' identifiable information in industrial trash containers that were accessible to the public. These incidents were reported as occurring in a variety of cities across the United States. Rite Aid pharmacy stores in several of the cities were highlighted in media reports.

Disposing of individuals' health information in an industrial trash container accessible to unauthorized persons is not compliant with several requirements of the HIPAA Privacy Rule and exposes the individuals' information to the risk of identity theft and other crimes, the HHS noted.

"It is critical that companies, large and small, build a culture of compliance to protect consumers' right to privacy and safeguard health information," said Georgina Verdugo, director of the Office of Civil Rights, the HHS arm that undertook a joint investigation of Rite Aid with the Federal Trade Commission. "We hope that this agreement will spur other health organizations to examine and improve their policies and procedures for protecting patient information during the disposal process."

Among other issues, the reviews by OCR and the FTC demonstrate that:
* Rite Aid failed to implement adequate policies and procedures to appropriately safeguard patient information during the disposal process;
* Rite Aid failed to adequately train employees on how to dispose of such information properly; and
* Rite Aid did not maintain a sanctions policy for members of its workforce who failed to properly dispose of patient information.

Under the HHS resolution agreement, Rite Aid agreed to pay a $1 million resolution amount to HHS and must implement a corrective action program that includes:
* revising and distributing its policies and procedures regarding disposal of protected health information and sanctioning workers who do not follow them;
* training workers on these new requirements;
* conducting internal monitoring; and
* engaging a qualified, independent third-party assessor to conduct compliance reviews and render reports to HHS.

In addition to paying the settlement, Rite Aid signed a consent order with the FTC to settle potential violations of the FTC Act.

Billions in EHR Incentive Funds Up for Grabs as Doctors Go Digital Across the Country - July 20, 2010

Last week's announcement of final guidelines for medical providers and EHR vendors has officially kicked off the national health IT transition. CMS releases EHR meaningful use final rule - July 20, 2010

Orlando Florida --
July 19, 2010 — On Tuesday, July 13, the Centers for Medicare and Medicaid Services (CMS) released a Final Rule, which defines “meaningful use” of an electronic health record (EHR).

Demonstrating meaningful use of an EHR is one requirement for obtaining a federal incentive bonus for use of an EHR. In January, when the proposed rule on meaningful use was released, ACA identified a number of concerns with the proposed meaningful use criteria and ACA outlined those concerns in comments to CMS.

CMS’ final rule on meaningful use reflects changes in response to ACA’s concerns. Specifically, the requirement to electronically prescribe medication has

been modified so that individuals who write fewer than 100 prescriptions in one year will not have to meet the requirement to e-prescribe to achieve meaningful use.

In response to ACA concerns, CMS has also changed the criteria so that the performance of medication reconciliation is no longer an essential objective for demonstrating meaningful use.

Meaningful Use Rules Make Sense To Patients - July 20, 2010

I'm not a doctor or nurse. Nor am I a hospital administrator, CIO or health IT worker. However, I am a patient. So while the government's long-awaited, meaningful use, stage 1 "core objectives" could very well entail a lot of process changes and costly technology to implement for healthcare providers, from a patient perspective--my perspective--many of the requirements sound reasonable, even commonsensible.



For instance, among core objectives for healthcare providers in stage 1 is supplying more than 50% of patients with an electronic copy of the patient's health information within three business days of patients asking.

Patient's health information just that--the patient's information. An individual expecting to get a copy of his or her medical information within three days of asking sounds rational to me. Granted, waiting three days isn't exactly the same as real time access to data. But in some states today, rules say patients should be able to receive copies of their medical information "within a reasonable amount of time." That wait could last weeks.

So, by comparison, waiting no more than three days for getting an electronic copy is reasonable, unless a patient is in urgent need of these records sooner. Of course for healthcare providers who don't already have some kind of e-health record system plans in place, fulfilling those requests might sound impossible now. (Then again, isn't the chore of making photocopies of paper records for patients even more work for providers?)

Some consumers remain wary to conduct mobile transactions but perception, reality aren't in sync

The State of Mobile Security

Once a patient's health information becomes routinely digitized, it's also reasonable to expect that many records could be available to patients (via a portal, for instance) much sooner than three days--maybe immediately (as long as sensitive data, like important lab results, for instance, are vetted first by clinicians.)

Among other core requirements are maintaining active lists for health problems, diagnoses, drug allergies and medications for 80% of patients. Again, that's basic--but important information--that can help improve the safety and quality of care that patients receive, especially when patients receive care from multiple providers. Sounds like a no-brainer.


The next wave of meaningful use requirements that come in stages 2 and 3 will likely be tougher to meet, since health department officials admit that many of the original and more challenging stage 1 goals set out in the proposed rules released earlier this year are just being deferred to later.

And while the core requirements aren't perfect, from a patient's perspective, many appear very practical.

As time goes on, the government won't be the only one raising the bar in its meaningful use requirements. Patients' expectations in the quality and safety of care they receive--and timely, easy, secure access to their own health information--will continue to rise, too.

Erie County Medical Center Selects Allscripts Electronic Health Record - July 19, 2010

Allscripts announced today that Erie County Medical Center (ECMC) Corporation, a 550-bed academic medical center in Buffalo, has selected the Allscripts Electronic Health Record (EHR) for 100 of its physicians to enhance the quality of patient care, improve physician and patient communications, and better manage the cost of care delivery in 24 outpatient clinics.

A major teaching facility for the University at Buffalo, ECMC also is a key participant in a regional health information organization (RHIO) that recently received a $16 million federal grant to increase the use of health IT in the Buffalo area for clinical quality improvement. ECMC was the value of the Allscripts solution in helping the organization to satisfy the “meaningful use” requirements of the American Recovery and Reinvestment Act (ARRA). In addition, ECMC’s relationship with UBMD, the University of New York at Buffalo’s faculty practice, a current user of Allscripts, will facilitate the transition from paper to electronic records for ECMC.

“The ability of Allscripts to make our healthcare system more efficient and to meet the needs of our clinicians is very important to us,” said Leslie Feidt, Chief Information Officer of ECMC. “The Allscripts EHR will also help us satisfy the government’s ‘meaningful use’ requirements, in part by enabling us to collect and report quality data. This will be very important in improving the quality of care and patient outcomes.”
Katrina Karas, Director of Ambulatory and Renal Services for ECMC, commented, “The Allscripts EHR meets the needs of our primary-care clinics as well as our many specialties, ranging from surgery and orthopedics to gastroenterology and anti-coagulation therapy.”

ECMC will link the Allscripts solution to the hospital’s inpatient Meditech Electronic Health Record and billing system, ensuring that their physicians inside and outside the hospital have access to the same patient information. ECMC also will implement the Allscripts Analytics solution to run quality reports and display them on an easy-to-use dashboard. According to Feidt, ECMC will use the analytics application not only for external reporting of quality data, but also internally to help physician leaders identify and remedy gaps in care.

Additionally, ECMC will deploy the Allscripts Universal Application Integrator (UAI), which enables customers to interface the Allscripts EHR with medical devices and third-party software without writing special interfaces. UAI allows Allscripts to add best-of-breed functionality quickly, often 12 to 18 months faster than other vendors can achieve using traditional development methods.

To get the system up and running in all of its offices in that time frame, MedWest will use the Allscripts READY accelerated deployment solution, a standardized implementation "tool kit" that provides best-in-class recommendations for products, certified workflows and implementation, along with automated processes for tracking and managing the implementation.

MedWest will deploy the Allscripts Practice Management System to its owned practices before it introduces the Electronic Health Record. Today, Heatherly explained, MedWest's 15 ambulatory-care offices are using half a dozen different systems. Bringing them all live on the Allscripts PM system will make MedWest's central billing office more efficient and will improve revenue cycle management. Similarly, replacing the disparate EMRs in current use with the Allscripts Electronic Health Record will make delivering patient care more efficient and effective.

Will digital medical records save your life? - July 19, 2010

As far as medical health records go, we're kind of trapped in a weird state of transition that can be confusing, frustrating, and even dangerous for patients.

Many doctor's officers and hospitals still use traditional paper files, or a mix of paper and electronic files, while fewer than 10 percent have transitioned into the world of electronic health records. But that number is likely to grow sharply over the next three years because of the American Recovery and Reinvestment Act of 2009. The stimulus package provides incentives for physician practices and hospitals to convert to electronic health-record systems that fit government criteria by 2014.

..Although it will be very difficult for 100 percent of doctor’s offices and hospitals to go electronic by the administration’s 2014 goal, there’s a good chance at least one of your healthcare providers will.

"Electronic health records incentives decrease over time, so the earlier doctors implement them, the more incentive money they earn," says electronic health records expert Paul Tang, MD, an internist and vice president and chief innovation and technology officer for the Palo Alto Medical Foundation in California. "After 2014, there's actually a penalty if you haven't implemented."

Currently, some health systems already use electronic health records to pull up patient history and lab results. However, these records don't contain patient information from other healthcare systems or specialists, and other institutions can't access the information. As doctors sign onto the government plan, though, all of your doctors, no matter what hospital or specialist you're seeing, will be able to pull up all of your health information in order to make the most informed decision on your care.

Voice Recognition Technology Shines on iPad - July 19, 2010

In case you didn’t know it, the iPad has a built in microphone. Yes, that’s right. It’s located at the top of the iPad. It’s the little pin sized hole next to the headphone jack. The reason I mention this is because not everyone is aware the iPad has a microphone. After all, the iPad isn’t designed to make phone calls like the iPhone so why does the iPad have a microphone?

One theory is that Apple designed the iPad with a microphone because they will later release the iPad with a camera and it makes sense to have a microphone for video chats. More likely, Apple put a microphone into the iPad to take advantage of voice recognition capabilities. As great as the multi-touch interface is on the iPad, there is nothing more natural than speaking with your voice.

There are two great free voice recognition apps for the iPad that have really impressed me. The first app I discovered that uses voice recognition technology is the Google mobile app.

Google’s mobile app allows you to search the Internet by using just your voice. It is amazingly accurate and fun to use. Google voice search is one of my iPad’s tricks that I always like to show off to people who’ve never seen the iPad. I feel like a magician when I ask people what they want to find, have them speak the words, and then have their search results magically appear on the iPad screen.

The second app I discovered that uses voice recognition is Dragon Dictation. Dragon Dictation is a wonderful free app from Nuance who is the industry leader in voice recognition technology. Dragon Dictation is a very simple app that allows you to speak words and have them instantly transferred into text. It works very well. In fact, it works so well that I wrote most of this article using the Dragon Dictation app.

I found that the Dragon Dictation app accurately translated my spoken words into text about 95% of the time. When I needed to make a correction, it was easy to do so using the pop-up keyboard at the bottom of the screen. The accuracy may improve if you plug in an external microphone (which Nuance recommends for best performance) but I’ve just been using the iPad’s built in microphone.

One of the great things about the Dragon Dictation app is that there is no learning curve necessary unlike some other voice recognition software. The Dragon app instantly recognizes your voice without any training and you can easily email the text from within the Dragon app or copy and paste the text you’ve created into other apps.

I can definitely speak a lot faster than I can type on the iPad so I plan on using the Dragon app quite frequently. My job requires me to be on email a lot and writing a long email is definitely easier with the Dragon app than pecking away at the iPad keyboard. I would easily pay at least $9.99 for the Dragon Dictation app but the good folks at Nuance are giving it away for free. I highly recommend that everyone who has an iPad downloads this app.
