Best Practices for successful EHR implementation from a Provider - November 28, 2010

Tampa Florida -- Right people, right processes, right change management and right technology – these are the "four buckets" that one expert says her list of top 10 internal factors for implementing an EHR fall into. Without all the components, she says, it is very difficult for organizations to succeed.

She shared with Healthcare IT News her top 10 list, which she says has been generated from her own experiences and those of her clients:

Jenkins says when an organization is considering a technology change, it should take a top-down approach. It should, for example, start with the hospital's board, but should include all the members of an organization. "They have to understand that is it is an organizational priority," she said, and that it is a "transition for the entire organization."

2. Shared Vision

•A shared vision is understood and embraced by the organization.
• Patient safety is at the forefront.
•Goals and benefits are clearly defined, meaningful and measurable.
•Organization knows what success looks like and how to achieve it.
Jenkins recommends organizations hold their own "vision sessions" where key stakeholders come together to talk about how they envision the technology can improve patient safety and care.

3. Right Culture

•Organization prepares, supports and sustains people through effective change management for a culture of change.
"You have to provide the right resources in terms of equipment, technology, education and training. This is a huge undertaking," Jenkins said, but "this journey of change prepares them for other changes in the future."

•Up-front planning identifies potential roadblocks, areas of resistance and facilitates embracing change.
"Resistance comes from degree of change this requires," she says. There is also resistance from clinicians who believe this technology is not here to stay, and there has to be a commitment to learning the new technology. "It takes time to learn to use them [the technologies] efficiently and receive the benefits," added Jenkins.

4. Governance

•Efficient, clear decision-making structures are in place.

A good starting point, she says, is using a third party vendor tool, which already has a lot of content.

"Just in time training or JIT is training close enough to go live that clinicians don't forget it," said Jenkins. In other words, "use it so they don't lose it." She says this requires more than just training of functionality of the system, it needs to relate to the role that we [clinicians] have, in order to make it meaningful." The training for docs may be different than for nurses she said. "The content has to fit the type of role they perform in patient care," Jenkins added.

HHS to identify by name all private practices experiencing a breach affecting 500 or more - November 21, 2010

Orlando Florida -- As you know, HIPAA-covered entities experiencing a security breach are obligated to notify affected individuals, the U.S. Department of Health and Human Services (HHS), and, in some cases, the media. When a breach affects 500 or more individuals, the covered entity must report the incident to HHS within 60 days of discovery.

HHS, in turn, provides a brief summary of the event on its website at www.hhs.gov/ocr/privacy/hipaa/administrative/breachnotificationrule/postedbreaches.html. To date, HHS has listed private practices anonymously, identifying them only as “Private Practice.” HHS took the position that private practices could not be specifically named on the website because they are identifiable as “individuals” within the meaning of the Privacy Act, which would potentially require the practice’s consent prior to listing it by name. Pursuant to the Privacy Act, HHS may designate its publication of breaches, including naming private practices, as a “routine use” of the information such that prior consent is not required for the publication.

Accordingly, on April 13, HHS published a Federal Register notice stating its intention to start identifying private practices by name on its breach website, designating such publication as a “routine use” of the information under the Privacy Act.

Although it has yet to do so, HHS has been entitled to name private practices (both prospectively and retroactively) since May 23, 40 days from publishing its Federal Register notice. Private practices (and other HIPAA-covered entities) should take steps to mitigate the risk of a security breach. Although a breach can occur in a variety of ways, almost half of the breaches reported on the HHS website were caused by lost or stolen electronic portable devices, such as laptops. In addition, BNA’s Privacy Law Watch reports that 80% of medical identity theft cases are caused by health organizations’ staff. As a result, portable media and dishonest employees are among the most likely causes of a security breach. HIPAA covered entities also should implement a written procedure to respond to suspected breaches, as mandated by recent revisions to the HIPAA Privacy Rule. A sound procedure will help covered entities, including private practices, respond promptly to suspected breaches, enabling them to meet the 60-day reporting deadline if their investigation of the breach determines it must be reported to individuals and HHS.

CMS Answers Meaningful Use Questions - November 14, 2010

Orlando Florida -- The Centers for Medicare and Medicaid Services' EHR Incentive Program Web site contains a variety of information for providers seeking incentive payments for meaningful use of electronic health records. Among the features is a Frequently Asked Questions page that as of mid-November had answers to 106 questions. Here's a sample:

Question: How will eligible professionals (EPs) and eligible hospitals apply for incentives under the Medicare and Medicaid Electronic Health Record (EHR) Incentive Program?

Answer: Information on registration for EHR incentive programs will be available toward the end of 2010 on our website at http://www.cms.gov/EHRIncentiveProgram. Registration for the Medicare EHR Incentive Program will begin in January 2011 and will be available online. Registration for the Medicaid EHR Incentive Program may also begin in January 2011, but the timing will vary by State.

Question: A number of measures for Meaningful Use objectives for eligible hospitals and critical access hospitals (CAHs) include patients admitted to the Emergency Department (ED). Which ED patients should be included in the denominators of these measures for the Medicare and Medicaid Electronic Health Record (EHR) Incentive Programs?

Answer: Our intent is to include in the denominator visits to emergency departments (EDs) of sufficient duration and complexity that all of the Meaningful Use objectives for which the ED is included would be relevant. We also want to encourage integration of the inpatient and emergency departments by including inpatient admissions that occur through the ED. Therefore, we are clarifying the following specifications for including ED services in the denominator for measures associated with Stage 1 of Meaningful Use objectives for eligible hospitals and critical access hospitals (CAHs):

* The patient is admitted to the inpatient setting through the ED. In this situation, the orders entered in the ED using certified EHR technology would count for purposes of determining the computerized provider order entry (CPOE) Meaningful Use measure. Similarly, other actions taken within the ED would count for purposes of determining Meaningful Use

* The patient initially presented to the ED and is treated in the ED's observation unit or otherwise receives observation services. Details on observation services can be found in the Medicare Benefit Policy Manual, Chapter 6, Section 20.6.

Question: Who can enter medication orders in order to meet the measure for the computerized provider order entry (CPOE) meaningful use objective under the Medicare and Medicaid Electronic Health Record (EHR) Incentive Programs? When must these medication orders be entered?

Answer: Any licensed healthcare professional can enter orders into the medical record for purposes of including the order in the numerator for the measure of the CPOE objective if they can enter the order per state, local, and professional guidelines. The order must be entered by someone who could exercise clinical judgment in the case that the entry generates any alerts about possible interactions or other clinical decision support aides. This necessitates that CPOE occurs when the order first becomes part of the patient's medical record and before any action can be taken on the order. Each provider will have to evaluate on a case-by-case basis whether a given situation is entered according to state, local, and professional guidelines, allows for clinical judgment before the medication is given, and is the first time the order becomes part of the patient's medical record.

Question: In a group practice, will each provider need to demonstrate meaningful use in order to get Medicare and Medicaid electronic health record (EHR) incentive payments or can meaningful use be calculated or averaged at the group level?

Answer: Yes. Medicare and Medicaid incentive payments are made on a per EP basis, not by practice. Each EP will need to demonstrate the full requirements of meaningful use in order to qualify for the EHR incentive payments. We made this clear in the preamble to the final rule when we declined to adopt alternative means for demonstrating meaningful use on a group-practice level (75 FR 44437).

CMS Payments starting in May 2011, Will you be Ready? - November 2, 2010

A recent comment from Jim Cook from Meta Group had a nice checklist of items that doctors and practice managers could start doing to make sure that their EMR implementation is ready to meet the meaningful use standards. This is not an exhaustive list, but I thought was a good list for those providers wanting to being their preparation for showing meaningful use and obtaining the EMR stimulus money.

Everyone should keep in mind that there are few systems Certified at this point, one example would be gloStream (see www.glostream.com)

Here are some things to check as you get ready to claim your incentives for EHR Meaningful Use under the HITECH Act. This information is based on (EPs) qualifying for the Medicare incentives.

1) Start talking to your vendor about their plans to submit their EHR software for certification as Certified EHR Technology. The system does have to be certified as of January 1, but it does need to be certified by the end of the 90 day period you are using to attest to your EHR Meaningful Use.

2) Keep in mind that if you are using a stand alone EMR product with an existing legacy practice management (PM) system, the system needs to be Certified EHR Technology also. This is because some of the functions of a certified system, such as recording patient demographics electronically, are most likely functions of your PM system, not the EMR product. So talk to that vendor, too.

3) Verify that any eligible provider attesting to meeting EHR Meaningful Use objectives provides 10% or more of his/her Medicare services in an outpatient setting (not inpatient or in a hospital ED). CMS will look at the percent of services rendered in an outpatient setting for the fiscal year ending 09/30/2010 to determine the IP/OP percentages. Your EHR healthcare consultant must be qualified to do the analytical and reporting work in preparing the self-attestation report, based on the current fiscal year and the individual EHR Meaningful Use objectives in place, starting January 2011.

4) Make sure all eligible providers you are planning to certify for EHR Meaningful Use have an NPI number and are enrolled in PECOS.

5) For EPs in group practices, confirm the tax Id number group or personal of each provider for payment of the incentive amount. Payments can be made to either number.

6) CMS will be establishing an Internet-based enrollment process for EPs planning to apply for incentive payments. Keep checking this site for the Registration process, and enroll when it is available.

7) As soon as you start the clock on your 90 day period, make sure you are meeting all the EHR Meaningful Use objectives applicable to your practice, and, for objectives with numerical thresholds, that you are attaining the levels specified. If your EHR system is Certified EHR Technology, it should be capable of supporting all Stage 1 Meaningful Use objectives.

8) Monitor the CMS website on EHR Incentive Programs to determine the format of the attestation for 2011. And keep in mind that accuracy is paramount; attesting to EHR Meaningful Use is making a claim to a Federal program. And the penalties for false claims are significant!

Surgeon General Weighs in on EHR - October 13, 2010

Orlando Florida -- If ever there was a compelling story in favor of EHR adoption, Surgeon General Regina M. Benjamin told it at the 82nd annual AHIMA convention and exhibition.

It took two hurricanes and a fire to drive home the importance of EHRs. Not surprisingly, Gulf Coast states such as Alabama and Louisiana understand that lesson. In truth, we as an industry and a country should not have to experience this kind of devastation and its long-lasting impact to healthcare access and patient safety to embrace the benefits of EHRs.

Clearly, there are privacy and security issues that need to be adequately addressed to ensure the public, patient privacy advocates and all healthcare providers that everyone's information will be handled in a safe manner.

We have all read about privacy breaches and thefts of electronic health data. People forget that paper documents are not more secure. The story Benjamin told of having to dry row after row of paper patient medical records out in the sun should make patients and privacy advocates shudder.

Beyond the officials overseeing HIPAA compliance, was there any outcry about privacy violations at the time? I'm sure there were records so wet they tore and were rendered useless. Paper records reduced to ashes are equally useless. Maybe you or I can recal our procedures and medication list, but the elderly likely cannot.

Best Practices for Family Physicians to adopt EHRs - October 13, 2010

Steven Waldren, MD, director of the Center for Health Information Technology for the American Academy of Family Physicians, has helped many small physician practices implement and adopt EHRs.

At yesterday’s National Regional Extension Center & Health Information Exchange Summit West in San Francisco, Waldren shared best practices and lessons learned.

Before your office makes any changes, you need to have a financially stable practice, he said. Implementing an EHR is a major disruptive process and one that can shut a small practice down if it isn’t stable enough to endure a steep learning curve.

Next, you need to ensure that you have leadership, management and teamwork in place to guide the office through this transformative time.

Finally, small practices need to understand that implementing technology requires dedicating time for change management and process design, so find a partner that has done this before, a partner that has certiifed trainers and local support, like Sencilo HealthIT Solutions.

Waldren outlined four steps to health IT adoption, and those steps must all be taken and in this order: preparation, selection, implementation and maintenance. Do not go directly to select. A lot of preparation must be done in order to determine how your office goes about selecting a vendor.

Waldren talked about driving quality with health IT. Meaningful use means being able to track and measure quality metrics for improved patient care. But you can’t measure if you can’t capture discrete data in a standardized form. That’s the value of health IT.

Small physician practices often ask how to embed knowledge into their system. Waldren recommends developing evidence-based documentation templates for your EHR.

The physician office needs to ensure that the system that is implemented needs to be reliable in order to track tasks and results.

Implementing a system will result in a shift of work among office staff. Take advantage of the technology to allow team members to do high-level task. In the meantime, remember to remove repetitive tasks and increase communication within the care team especially during the learning curve.

Finally, stop the paper chase; in other words, once you adopt health IT, don’t cling to the old processes.
