DEA Interim Ruling on Electronic Prescriptions for Controlled Substances - May 25, 2010
Orlando -- Florida March 31, 2010 the Drug Enforcement Agency (DEA) published the Electronic Prescriptions for Controlled Substances Interim Final Rule (IFR). Its purpose is to establish rules for the electronic submission of controlled substances.
OVERVIEW
The IFR sets rules for allowing electronic prescribing of controlled medications. The focus is on diversion and non-repudiation. Stringent security requirements have been defined that focus on the key areas of identity proofing, access control, two-factor authentication, and audit requirements. The IFR gives prescribers the option of signing and transmitting prescriptions for controlled substances electronically. Written, manually signed, and oral prescriptions for controlled substances, where applicable, are still permitted.
COMPLEX PROCESS
This is an important milestone and has started an industry-wide process of technical advance. New layers of infrastructure will be developed at the local, state and national levels to enable the industry to create a system that meets the DEA's new security requirements. Here are a few examples of the changes required to turn this rule into reality:
Processes will be developed to validate the identity of all legally authorized prescribers. Credentials for electronic prescribing of controlled substance will be issued.
National standards that govern communication of digitally-signed prescriptions will be defined. Electronic prescribing vendors (such as Allscripts) will need to incorporate the new standards and requirements into products. Pharmacy software vendors will adapt their systems to accept incoming controlled substance e-prescriptions and to validate their authenticity.
WHAT'S NEXT?
Given the complexity of implementing these changes, it remains unclear precisely when the industry will be ready to enable providers to electronically prescribe controlled substances. While Allscripts expects that this process will take 12-18 months, we are working hard with our industry partners to accelerate this timeline wherever possible.

Providers should continue to electronically create and print controlled substance prescriptions using the Allscripts prescribing solutions that they currently use.

Doc calls EHR copy and paste function a "modern medical illness" - May 24, 2010

NEW YORK – The copy and paste function of an electronic health record is "one of the most egregious dangers of electronic charting," according to a recent editorial in the American Journal of Medicine.
Arie Markel, MD, director of one of the departments of internal medicine at a hospital in Israel, found out first hand the ill effects of copying and pasting in patients' charts.
Markel wrote a letter entitled "Copy and Paste of EHRs: A Modern Medical Illness" in response to the AJM editorial in which he said he "identified strongly" with the subject of the editorial written by Ronald Adelman, MD, medical director of the Irving Wright Center of Aging and co-chief of the Division of Geriatrics Medicine and Gerontology at The New York-Presbyterian Hospital, and Eugenia L. Siegler, MD, medical director of the Geriatrics Inpatient Service at the Weill Cornell Campus of New York Presbyterian Hospital.
Adelman and Siegler said some of the problems with copying information from a prior note and pasting it into a new one are that it reduces the credibility of the recorded findings, clouds clinical thinking, limits proper coding, and robs the chart of its narrative flow and function.
Markel said that in reviewing patient charts at his hospital he found that the copy and paste function was of the "same magnitude" as described in the AJM editorial.
"Medical diagnosis in previous admissions that have no relevance for the present hospitalization are repeated and copied from one summary to the other. Previous medications are copied and printed as if they were the patient's current treatment even if the patient is no longer taking them. Data presented in a previous hospitalization are repeated without changing the details or actualizing the date; subsequently the reader may not be able to understand or may misinterpret the data," said Markel.
But Markel says it is not just the copy and paste function that is problematic, but all computer functions that allow automatic copying of all previous chart diagnoses, physical examination results, and whatever else is in the chart.
The AJM editorial suggested that disabling the copy and paste function in the EHR could be a way to eliminate the problem, but said that staff were still able to copy and paste from documents saved in text formats outside the electronic chart.
Markel said the problem became so serious at his medical center that they did just that, but came up against the same problem of not being able to completely eliminate the use of copying and pasting from other documents.
"As computer techniques advance and are of immeasurable help in our work as physicians and investigators, the way to overcome uses and abuses of this medium in our routine work seems to remain beyond us," said Markel.
The AJM editorial called for "thinking creatively" about charting as a communication tool.
"An electronic health record can document a patient's course, foster meaningful patient narratives, free up more time for direct patient contact, and advance care by enhancing both intradisciplinary and interdisciplinary communication. To do so, we must change not only the health record but also the way we create it, evaluate it and use it," the article concluded.

"ePediatrics" something parents want - May 24, 2010

ANN ARBOR, MI – "ePediatrics" could become more common, as parents are requesting more electronic communication with their children's doctors, according to a new poll.
According to a national poll by C.S. Mott Children's Hospital in Ann Arbor, Mich., about one-half of parents think it would be very helpful to be able to accomplish administrative and clinical tasks such as requesting records or prescription refills through e-mail or online.
The poll, conducted by Knowledge Networks, Inc. in January 2010, asked 1,612 parents of children ages 0-17 across the United States about how they communicate with their children's healthcare providers.
Although the poll found that half of parents would like to have access to electronic communication features with their children's doctor's office, less than 15 percent of parents reported that they are currently able to have online or e-mail communication with their children's healthcare providers.
"Electronic communication between parents and their children's healthcare providers offers a lot of potential benefits," says Matthew Davis, MD, director of the poll and associate professor of pediatrics and communicable diseases in the CHEAR Unit at the University of Michigan Medical School. "For administrative tasks that almost all parents need to complete, electronic communication can reduce wasted time and minimize frustration for both parents and office staff. For clinical services, parents often have questions about whether minor injuries or illnesses require an office visit; electronic communication provides a way to obtain advice without waiting on hold for long periods of time."
In a similar study by Johns Hopkins Children's Center nearly 90 percent of the 229 parents polled said they would welcome e-mail as a way to communicate with their child's doctor. The study, which was conducted earlier this month, found that only 11 percent could currently do so. Hopkins investigators said they are planning a study of pediatricians' attitudes toward e-mail.
Most physicians who are reluctant to e-mail today, chose not to because they are not reimbursed for electronic services or because they are concerned that these types of services could leave them susceptible to medical liability.
"Some healthcare providers have expressed concerns about reimbursement for electronic services that require staff time. Others worry about medical liability associated with offering clinical advice via e-mail or the Internet, without examining the patient," says Davis, who is also associate professor of internal medicine and associate professor of public policy at the Gerald R. Ford School of Public Policy. "However, given the strong endorsement for electronic communication from this national sample of parents, significant efforts should be made to address these challenges. The obvious advantages of electronic medical records – efficiency, clarity, documentation – are the same reasons why we should work to make e-communications available for our patients and families."

Medicare, Medicaid to boost Web sites - May 24, 2010

WASHINGTON – The Centers for Medicare & Medicaid Services will spend $73.2 million to update three Web sites that garner more than 500 million page views a year from beneficiaries.
CMS awarded the five-year contract to CGI Federal in a competitive bid.
The three Web sites – Medicare.gov, cms.hhs.gov, and MyMedicare.gov – serve as CMS's online communication channels for beneficiaries and providers. The sites offer information about coverage, claims, medications and eligibility.
"CMS is at the forefront of the national health agenda," said George Schindler, president of CGI Federal. "CGI is proud to be chosen again to support their efforts which directly impact so many citizens."
CGI has been working with CMS to evolve the Web sites to better meet the agency's mission of education, outreach and service, as well as government requirements for increased transparency, participation, and collaboration.
For example, Schindler said, the Hospital Compare and Nursing Home Compare tools combine geographical data from Google maps with healthcare provider quality-of-care information to help users locate and assess healthcare facilities near them.

CMS says, don't look for CCHIT certified EHRs, look for ARRA certification! - May 9, 2010
Orlando Florida -- The stated aim of the financial incentives offered for EHR adoption under the American Recovery and Reinvestment Act (ARRA) is to encourage "the use of certified EHR technology in a meaningful manner." This goal is the cornerstone for building an interoperable health information technology infrastructure to improve the quality, safety and efficiency of care. Consequently, interoperability and connectivity are emphasized in the Stage 1 EHR certification requirements, says Brian McCarthy, CEO of Sencilo HealthIT Solutions and well known speaker in the healthcare sector.
CMS decided not to adopt previous certification standards, on the basis they were insufficient to meet all the requirements of meaningful use. This means that CCHIT-certified EHR systems -- not the same as "EHR technology" under the interim rules for EHR certification -- will need to meet new certification requirements to ensure that their users can meet the final meaningful use criteria, which will be published later this spring, says McCarthy.
Meanwhile, the government has made it clear that a qualified EHR may either be a "complete EHR" or consist of "EHR modules," as long as they're certified. So it's possible for providers to have certified EHR technology that combines modules from different vendors. Users of these modules will be in a position to meet the meaningful use requirements and qualify for ARRA financial incentives. While this is not the best method, it is true. What we see customers doing is looking for a simply, integrated application, that is affordable. Sencilo reviewed two dozen EHR products prior to choosing Allscripts MyWay. In fact McCarthy says, we even looked at the Allscripts Professional version and spoke with customers, all stated "the complexities were far more then a small medical office could afford to run or support."
The last few years have seen the emergence of a number of Web applications offering solutions like eligibility determination, claims submission, e-prescribing, lab ordering and results, personal health records, and educational materials. Some of these applications have already been accepted as mainstream, including Allscripts-Misys MyWay. A number of them will get modular certification and play a key role in helping users to meet the meaningful use requirements, both as standalone applications and in combination with EHR technology.

Data Storage Report points to digital tsunami ahead and EHR is at the Heart of it all! - May 9, 2010
Orlando Florida -- If healthcare CIOs think they’ve gotten busier as health information has become increasingly digitized over the last few years, a recent study indicates that, as the pop song goes, they “ain’t seen nothin’ yet.”
The study, titled "The Digital Universe Decade – Are You Ready?", was sponsored by EMC Corporation, and it provides a startling look at how much digital information is going to be produced in the years ahead.
As the report puts it, “think of the growth of the Digital Universe as a perpetual tsunami. As this universe grows by an order of magnitude, we will have to deal with information in new ways: How will we find the information we need when we need it? We will need new search and discovery tools. . . .How will we know what information we need to keep, and how will we keep it? Yes, we will need new technical solutions tied to storage, but we will surely also need new ways to manage our information. . . . How will we follow the growing number of government and industry rules about retaining records, tracking transactions, and ensuring information privacy? . . .How will we protect the information we need to protect? If the amount of information in the Digital Universe is growing at 50% a year or so, the subset of information that needs to be secured is growing almost twice as fast.”
While the report doesn’t look specifically at the healthcare sector, the implications are clear. Storage, security, portability, accessibility; these and other information issues are front and center for IT managers and policymakers both inside and outside the healthcare sector.
And as this report makes clear, given the size of the digital wave that’s coming, treading water is just not a realistic option.
