Blumenthal Offers Meaningful-use Approaches - June 2, 2010

David Blumenthal, head of the Office of the National Coordinator for Health Information Technology at HHS, took to e-mail and the Web last week to get the word out about an alternative way for providers to communicate to meet federal meaningful-use requirements and qualify for billions of dollars in health IT payments.
The American Recovery and Reinvestment Act of 2009, also known as the stimulus law, requires that providers must meaningfully use an electronic health-record system to qualify for up to an estimated $27.3 billion in federal reimbursements.
Last December, the CMS, which will administer the EHR funding under the Medicare and Medicare Advantage programs, issued a proposed rule defining the meaning of meaningful use. Congress, however, mandated three meaningful-use criteria that providers must meet—electronic prescribing, reporting quality measures to HHS and exchanging information electronically to improve patient care.
As proposed, the nationwide health information network will be capable of handling all three mandated transactions. However, as originally contemplated, the NHIN was to be a “network of networks,” reliant on local, regional or statewide exchanges to serve as on-ramps to the NHIN.
With the clock running down on the start of the stimulus law funding program—the first “payment year” for the Medicare portion of the plan begins Oct. 1—and with only a limited number of the exchanges up and running, the government came up with an alternative method of peer-to-peer connection called NHIN Direct so that providers without access to an exchange or the techno-savvy to use it could still meet the meaningful-use criteria and qualify for EHR payments.
“To make meaningful use possible, including the necessary exchange of information, we need to meet providers where they are, and offer approaches that are both feasible for them and support the meaningful-use requirements of the Centers for Medicare & Medicaid Services Electronic Health Record Incentives Programs,” Blumenthal wrote on May 14. “As with the Internet, it is likely that what is today considered ‘highly sophisticated' will become common usage. Moreover, users may engage in simpler exchange for some purposes and more complex exchange for others.”
There are examples of the NHIN's “high level of interoperable health information exchange,” Blumenthal said, specifically touting work in this area by the Defense Department, Social Security Administration, Veterans Affairs Department, Kaiser Permanente and MedVirginia, which “came together to show, on a pilot scale, that this type of highly evolved exchange was possible.
“Having succeeded, they continue to expand the level of exchange among their group and with their own respective partners in a carefully phased way to demonstrate and learn from these widening patterns of exchange,” he said.
Using the standards, services and policies that constitute the NHIN, these pioneers are using the system for what Blumenthal describes as “robust exchange,” including finding and accessing patient information among multiple providers, supporting the exchange of information using common standards; and documenting trust agreements between participants, such as Data Use and Reciprocal Support Agreements.
However, Blumenthal said, not every organization or provider “needs or is ready for this kind of health information exchange today. Nor do the 2011 meaningful-use requirements set forth by CMS in the recent proposed rule require it. Direct, securely routed information exchange may meet the current needs of some providers for their patients and their practices, such as receiving lab results or sending an electronic prescription.”
That's where NHIN Direct comes in.
Still under development by HHS, the NHIN Direct Project is a set of open-source software and standards aiming “to create a means for direct electronic communication between providers, in support of the 2011 meaningful-use requirements.”
While NHIN Direct remains a work in progress, Blumenthal said, “We are on an aggressive timeline to define these specifications and standards and to test them within real-world settings by the end of 2010. Timing is critical so that we may provide this resource to a broader array of participants in health information exchange as a wave of new, meaningful users prepare to qualify for incentives provided for in the HITECH Act and ultimately defined by CMS.”
“It is meant to enhance, not replace, the capabilities offered by other means of exchange,” Blumenthal said, adding that an example of an NHIN Direct transaction would be sending an electronic referral letter along with a patient-care summary from a primary-care physician to a specialist.
Blumenthal also issued a call for help and participation in developing and using the new, peer-to-peer channel.
“The NHIN Direct Project will conduct an open, transparent and collaborative process throughout its development by using a community wiki, blogs and open-source implementation already available on the project's website,” he said. “I encourage you to participate through the website, via public participation at the implementation group meetings, and by deploying and testing the resulting standards and specifications.”

No Meaningful Use Without Meaningful Measures - June 2, 2010

Last January, the Office of the National Coordinator for Health Information Technology (ONCHIT) published the Notice of Proposed Rule (NPRM) which provided further definition of "Meaningful Use" and outlined the specific health IT functional measures and clinical quality measures for Stage I compliance. During the subsequent comment period, concerns were expressed by providers, vendors and other parties highlighting the fact that collecting and producing the required measures could be as challenging as implementing the software capabilities.
I believe the respondents concerns are well founded. For decades healthcare software vendors have focused on the automation of specific tasks and workflows while reporting and metrics were treated as a byproduct or the "exhaust" of the healthcare computing process. The result was a tremendous amount of "data noise" with limited content to let decision-makers at all levels understand where the organization stood and what actions were needed. To remedy the situation, extensive manual processes and spreadmarts were implemented to produce the reports needed by senior executives. To be fair, some HIT vendors recently begun to recognize that their customers need better reporting tools and have expanded their reporting capabilities but there is still a lot of work to be done.
On May 17th, the Centers for Medicare and Medicaid Services (CMS) awarded Northrop Grumman a $34M contract to develop a National Level Repository database to process HITECH incentive payments. This database will store informatin about whether medical professionals and hospitasl are meaningful users of electronic health records, the date and amount of any incentive payments made to them and their tax identification number. It will serve as a key component of CMS' infrastructure to collect, analyze and act on the data submitted by providers and will evolve as subsequent HITECH reporting requirements evolve.
While the term "Meaningful Use" has recently become in vogue, many leading healthcare providers have been investing in physician adoption, clinical excellence, and informatics for several years. These pacesetters recognize that improving the quality of cost-effective care is impossible without the ability to capture and act intelligently on quality management and clinical information. Many of these same providers also understand that the primary reason for pursuing these goals is to improve the quality and delivery of cost-effective care while the HITECH incentives are merely a temporary facilitator. As government and payers collect additional information, providers must become more adept at using clinical and performance measures if they are to survive.
As Meaningful use requirements continue to evolve, it is clear that providers will need the data infrastructure and business intelligence capabilities in place in order to measure, monitor, act on, and submit the required measures. Just as demonstrable excellence in care delivery requires measurable results, there is "no Meaningful Use without meaningful measures".

Making Real-time Improvements - June 2, 2010

Certain anachronisms persist in health care. "Fifty years ago, our grandparents walked into a doctor's office and were handed a clipboard with forms to fill out," says Pradeep Vangala, M.D., founder and president of Orlando Internal Medicine, Florida. "Why should the same thing be happening now? People take it for granted and it needs to change."
To usher in this new era, the seven-physician practice last year deployed kiosks and touch-screen monitors, which interface with its electronic health record and practice management system. The kiosks, manufactured by NCR and running software from Patient Point Solutions, enable patient self-service at both check-in and check-out. Moreover, the set-up brings patients into the financial loop as well, alerting them at the end of the visit about their financial obligations. That's due to an interface with the group's real-time claims adjudication transaction capability it has set up with its major payers. "For over 40 percent of our billing, we do real-time claims adjudication," Vangala says.

The new system, Vangala says, has produced benefits for both the practice's patients and its bottom line. From the provider standpoint, incorporating real-time claims adjudication into the revenue cycle process significantly shortens the billing cycle. Traditionally, a patient comes in to a doctor's office, shows an insurance card, receives care and is long gone before a claim is settled with the insurance company. If, say, a month later, the insurance company determines the patient is responsible for more of the bill then was paid during the initial visit, it falls on the practice to collect from the patient.
At Orlando Internal Medicine, the process is streamlined as the technology enables the practice to contact payers in real time and calculate the payment and patient responsibility automatically. At the end of the patient visit, the biller is alerted through the provider's practice management system. After the proper billing codes are entered, the charge goes to the payer. The claim is adjudicated and the information about patient obligation comes back to the biller. The patient is prompted at the kiosk and, if they so choose, can pay instantly with a credit card.
Thus, the patient knows the exact amount of their obligation before they leave the premises. "It's much like a credit card transaction-you get an answer right away before the patient leaves." Vangala says, estimating that almost 50 percent of patient financial obligations in health care is written off as bad debt. "This is tens of billions of dollars written off annually. It is imperative that physicians collect the money that is due to us."
Since moving to real-time adjudication in the fall of 2009, Vangala has seen a 12-percent decrease in bad debt.
There have been other financial benefits too. One is lower billing costs, as electronic processing eliminates the expense of sending multiple statements to the patient long after the services have been provided. Another benefit is a marked reduction in time spent interacting with patients' health plans.
What's more, providers embracing real-time claims adjudications will see a significant reduction in the gap between the time of billing and actually getting paid, Vangala contends. "Instead of 60 to 90 days waiting for payment, you get the money in your bank account within seven days," he says. "All this converts into a significant amount of money for the practice that was not there until now."
While self-service kiosks are commonplace in airports and banks, they have struggled to gain a foothold in the customer-facing aspects of health care. "The concept is not new or ground breaking," Vangala says. "It's been around awhile, but it's never really taken off."
Vangala says kiosks in health care are a tough sell for a variety of reasons. One reason was cost, with practices unwilling to pay upfront for a novel technology. Additionally, some systems suffered from cluttered interfaces or had screens that pestered patients with advertisements.
The system Orlando Internal Medicine chose surmounts these problems, Vangala says, and includes other technological features that helped convince the practice to take the plunge. One such feature is built-in prescription adherence management software. Prior to meeting with the physician, the kiosk shows patient a list of medicines and asks if they are taking them, so that the physician has information handy prior to seeing the patient. "The software has some really cool built-in features that are medically useful," Vangala says.
Why Now?
For example, during check-in, the software identifies a patient's pharmacy benefit manager membership and tells them about savings opportunities such as generics that can and reduce their bill. "When you save them hundreds or thousands of dollars you end up looking like a hero to your patients," he says.
In addition to improvements to the technology, Vangala sees other, external forces pushing providers to examine real-time billing. One reason, he says, is looming Medicare cuts.
"Reimbursements are going down and physicians are looking at ways and means to save money," he says, adding that physicians need to think like small business owners. "As much as we would love to just see our patients, it's a business."
While much talk (and stimulus dollars) has coalesced around electronic health records, customer-facing technology has been largely ignored. "Everybody talks about digitizing medical records but what about the front office?" Vangala asks. Another factor buoying real-time claims is the move toward patient-directed health care as health savings accounts gain in popularity. "Now it's more relevant than ever," Vangala says.
Despite this, Vangala acknowledges there was some initial concern on his part as the practice implemented the system. "One thing physicians are concerned about is how any new technology will affect patient flow in the office. The absolute beauty of the kiosk system is that there is no disruption in the patient flow."
Vangala also fretted how his patients would react to the new system. But removing some of the opacity from the process from the patient perspective and empowering them with data, has allayed those fears, he says. "Initially there was a small amount of apprehension about how our patients would take it," he says. "With very few exceptions, our patients have been overwhelmingly receptive to the idea. Once you show that to the patient it makes it much easier. Ultimately, you are going to have difficult patients to deal with whether you use real-time billing or not."
Perhaps just as important as patient buy-in is payer support. Vangala notes that Medicare-which covers 45 percent of the practice's patient population-as well as Humana and the Florida Blues plans support real-time adjudication. "I think it is going to be the wave of the future," he says. "I'm happy to be an early adopter."

HIPAA and HITECH - What is Protected Health Information? - June 2, 2010

The HIPAA rules all speak of “protected health information,” or PHI. What does that really cover? It is important to understand what it is so that you are sure you have the correct protections in place. Let’s explore the definition of PHI a bit here. The rule defines individually identifiable health information as:
Individually identifiable health information is information that is a subset of health information, including demographic information collected from an individual, and…
1. Is created or received by a health care provider, health plan, employer, or health care clearinghouse; and
2. Relates to the past, present, or future physical or mental health or condition of an individual; the provision of health care to an individual; or the past, present, or future payment for the provision of health care to an individual; and 1. That identifies the individual; or 2. With respect to which there is a reasonable basis to believe the information can be used to identify the individual.
It then goes on to define “protected health information” in this way: Protected health information, or PHI, is individually identifiable health information:
1. Transmitted by electronic media; or
2. Maintained in electronic media; or
3. Transmitted or maintained in any other form or medium.
What that tells us is that it covers health information in ANY form. While the privacy rule applies to the information in any form, the security rule focuses on information that is created and stored electronically, including spoken conversations.
What about De-Identified Information?
The rules do allow for the use of information if it is de-identified. What is important to remember here is that the rule includes several things that must be removed before something is considered de-identified. Here’s the list:
(A) Names;
(B) All geographic subdivisions smaller than a state, including street address, city, county, precinct, zip code, and their equivalent geocodes, except for the initial three digits of a zip code if, according to the current publicly available data from the Bureau of the Census: (1) The geographic unit formed by combining all zip codes with the same three initial digits contains more than 20,000 people; and (2) The initial three digits of a zip code for all such geographic units containing 20,000 or fewer people is changed to 000.
(C) All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, date of death; and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older;
(D) Telephone numbers;
(E) Fax numbers;
(F) Electronic mail addresses;
(G) Social security numbers;
(H) Medical record numbers;
(I) Health plan beneficiary numbers;
(J) Account numbers;
(K) Certificate/license numbers;
(L) Vehicle identifiers and serial numbers, including license plate numbers;
(M) Device identifiers and serial numbers;
(N) Web Universal Resource Locators (URLs);
(O) Internet Protocol (IP) address numbers;
(P) Biometric identifiers, including finger and voice prints;
(Q) Full face photographic images and any comparable images; and
(R) Any other unique identifying number, characteristic, or code, except as permitted by paragraph (c) of this
Historically, we have faithfully removed all demographic information from the headers of a report, and we have used the words “the patient” when a physician dictates the name of the patient. If you really look at the above list, you will see that it’s much more detailed than that. When a pacemaker is implanted, for example, the physician gives the model number and serial number, right in the middle of the report. With (M) above, that report is not considered de-identified information.
The rule also states that the information must be such that a reasonable person with a statistical background would not be able to figure out the person’s identity. Lastly, it says that the covered entity must not have knowledge that the information could be used, alone or with other information, to identify the person.
It is critical to understand the meaning of PHI and how it applies to your setting. It is also important that all persons involved in the workforce be clear on the definitions. Be sure you have research these rules so you understand them and know how they apply to your work setting.

Small Steps Could Support Grand Plan for Meaningful Use - June 2, 2010

If you think this whole "meaningful use" thing is a challenge, just wait 'til you hear what they're trying to do over in Europe.
Last week, the European Commission--think of it as the executive branch of the European Union--published its "Digital Agenda," a 10-year plan for IT advancement across the continent. Healthcare figures prominently in the agenda, including the goal of providing secure, online, patient-controlled medical records for many Europeans in the second half of this decade. There are some interim steps in the near term, though.
One aim, according to E-Health Europe, is to "increase safety and medical assistance to Europeans, for instance in an emergency abroad, by defining a minimum set of health information to be included on patient records that can be accessed electronically anywhere in the EU." This is to be done by 2012.
Let me repeat that: European leaders expect to have basic medical histories available to much of their populace across 27 countries within two years.
It sounds like a heady task, particularly since there are no fewer than 23 official languages in the EU. (Think about how elusive semantic interoperabilty is in the U.S. with mostly English involved.) But the standards for exchange of a minimum set of health data already exist, in the forms of the Continuity of Care Record and Continuity of Care Document, and they've already been accepted in many EU countries.
This goal actually sounds more achievable than, say, providing interoperable EMRs to 300 million Americans by 2014, since it's biting off a small piece rather than taking a big bite. That's kind of what another huge bureaucracy, the U.S. Department of Veterans Affairs, had in mind when it started its innovation initiative, asking employees to come up with ideas on how the Veterans Health Administration could improve care and save money.
Just before the long weekend, the VA announced the winners of its second such competition. Things like adding patient photos, search functions and support for touch-screen technology sound easily achievable. Simple enhancements can go a long way, even as part of a grand plan. Joins Harbor Medical Group as Second Practice in Massachusetts' South Shore PHO to Adopt Allscripts Solution
CHICAGO and PEMBROKE, Mass., June 1 /PRNewswire-FirstCall/ -- Allscripts (Nasdaq: MDRX) announced today that Healthcare South has selected the Allscripts Electronic Health Record (EHR) and Practice Management solution to enhance the quality of patient care, improve physician and patient communications, and better manage the cost of care delivery in its nine pediatric and family practice offices across the Boston area.

Healthcare South joins the Harbor Medical Group, a nearby multispecialty practice with 71 physicians, in using the Allscripts solution. Both groups belong to the South Shore Physician Healthcare Organization (PHO), which is partly owned by South Shore Hospital in Weymouth, Mass. The PHO provides subsidies to physicians who adopt Electronic Health Records and contribute quality information to the PHO.
"We have been impressed by Harbor Medical's success with Allscripts, and it was clear we should be on the same platform with them and the other South Shore PHO physicians who acquire EHRs in the future," said Francis J. With the help of the Allscripts READY Rapid Deployment program, which accelerates EHR implementation, Healthcare South expects to go live on the Electronic Health Record by the fall of 2010. A few months later, the practice will switch from its legacy practice management system to the Allscripts billing and scheduling system, including the Allscripts revenue cycle solution, which transmits more than 300 million claims per year with a first-pass claims acceptance rate of 98 percent.
Healthcare South will also implement Allscripts Analytics, which not only enables automatic tracking of performance on financial and quality measures – for example, the percentage of all diabetic patients whose blood glucose levels are not controlled – but also provides proactive patient and population management.
