Hospitals Fined for Privacy Violations - June 14, 2010

The California Department of Public Health has fined five hospitals--one of them twice--for violations of patient privacy caused by employees.

California state law authorizes the fining of facilities and individuals, and disciplinary action against licensed professionals, for privacy violations. For instance, Kaiser Bellflower Hospital in Los Angeles was hit with fines of $187,500 and $250,000 in 2009 after multiple employees improperly accessed the records of octuplets mother Nadya Suleman and her children. At least 27 employees were disciplined, fired or resigned.

The new fines against five hospitals total $675,000. The hospitals are:

* Community Hospital of San Bernardino, $250,000, for unauthorized access of records from 204 patients by one employee;

* Community Hospital of San Bernardino, $75,000, for unauthorized access of three patients' records by one employee;

* Enloe Medical Center in Chino, $130,000, for unauthorized access to one patient's records by seven employees;

* Rideout Memorial Hospital in Marysville, $100,000, for unauthorized access to 33 patients' records by 17 employees;

* Ronald Reagan UCLA Medical Center in Los Angeles, $95,000, for unauthorized access of one patient's records by four employees; and

* San Joaquin Community Hospital in Bakersfield, $25,000, for unauthorized access to three patients' records by two employees.

digg Question: My EMR claims to have all of the capabilities they will need to demonstrate meaningful use and qualify for ARRA incentives. Does that mean I will get the EMR stimulus money?

First of all, you might want to consider another EMR vendor. If they are saying this, then they are trying to mislead you and make more sales. No EMR vendor can claim that they have “all of the capabilities” for you to show meaningful use and qualify for the EMR stimulus money.

Why can I say this? Because the details for Meaningful Use are still not final. We don’t know what you’re going to have to do to show meaningful use and so how can an EMR vendor claim to have all of the capabilities? Short answer is that they can’t. So, go and read their press release again and see if they’re just telling lies or if there was a disclaimer of some sort (ie. according to the interim final rule).

On to the other point of you getting EMR stimulus money. Certainly your EMR will have to be a certified EHR (that’s still not defined either). Your EMR will also have to have the capabilities to show meaningful use. However, at the end of the day, YOU’re the one that’s going to have to see patients and Use the EMR in a way that all of the meaningful use criteria are met. If you do this to the satisfaction of CMS, then you’ll get the stimulus money.

Certainly you can’t meet meaningful use without the EMR vendor. However, the EMR vendor alone can’t qualify you for meaningful use either. It takes 2 to tango. Just remember that it’s much easier to tango when you have a great partner. A lousy partner makes it no fun for anyone.

HIPAA Experts: Mandatory Encryption Overdue - June 14, 2010

HIPAA compliance experts call the recommendation to mandate encryption on exchanges of electronic protected health information (ePHI) "overdue," "inevitable," and a necessary step toward ensuring a successful transition to electronic health records (EHR).

A privacy/security workgroup for the Office of the National Coordinator for Health Information Technology (ONC) reported last month that encryption should be mandatory for one-on-one exchanges between providers regarding treatments.

The workgroup of the monthly HIT Policy Committee in its May 19 meeting suggested that those exchanges should include:

•Encryption (no ability for facilitator to access content)
◦Encryption ideally should be required when potential for transmitted data to be exposed (mandate through meaningful use/certification criteria or HIPAA Security Rule modification)
•Limits on identifiable (or potentially identifiable) information in the message
•Identification and authentication
"I'd say it's long overdue," says Kate Borten, CISSP, CISM, president of The Marblehead Group. "Recall that the proposed security rule in 1998--that's 12 years ago--required that PHI be encrypted over the Internet. While there may have been a legitimate argument then that solutions weren't readily available and cost effective, there are solutions today."

John C. Parmigiani, MS, BES, president of John C. Parmigiani & Associates, LLC, in Ellicott City, MD, and former chairperson of the team that created the HIPAA Security Rule, says the recommendation was inevitable.

"It is merely recognition of what has become an industry best practice," Parmigiani says.

Encryption is not mandatory.

It is "addressable" under the HIPAA Security Rule. And the Department of Health and Human Services' interim final rule on breach notification creates a "safe harbor" for unsecured protected health information (PHI) that is encrypted by certain standards; in other words, covered entities and business associates (BAs) do not need to notify individuals on breaches involving such encrypted PHI.

If the workgroup's recommendation comes to fruition, it would "uncomplicate the situation that many healthcare organizations have been confronted with when trying to decide on encryption," Parmigiani says.

Back when the security rule was proposed in 1998, then finalized in 2003, encryption technology was immature, Parmigiani says.

Now, however, there have been "inroads in the understanding of encryption," he says, and widespread use of software and hardware encryption.

"Therefore, I believe that the formal recommendation is both timely and an essential component of successful HIT and is critical to the attainment of consumer confidence in a fully robust EHR and smoothly functioning HIE environment," Parmigiani says.

The privacy/security workgroup provides input to the Health IT Committee as it sets the ground rules for the criteria of "meaningful use" of EHRs.

CMS and the Office of the National Coordinator for Health Improvement Technology (ONC) December 30 released two anxiously-awaited regulations providing both the definition of "meaningful use" for EHRs and the standards to improve the efficiency of health information technology used nationwide by hospitals and physicians.

Currently, the ONC interim final rule, "Health Information Technology: Initial Set of Standards, Implementation Specifications, and Certification Criteria for Electronic Health Record Technology," requires that EHR systems be capable of encryption.

Final rules on the ONC interim final rule and CMS proposed rules are expected this spring. However, the interim final rule is in effect.

CDC Updates Recommendations for MMRV Vaccination - June 14, 2010

Physicians who provide care for children should be aware that the CDC has published updated recommendations for vaccination against measles, mumps, rubella and varicella. The recommendations, which have been adopted by the AAFP, offer clinicians insight into the preferred use of combination measles, mumps, rubella and varicella, or MMRV, vaccine versus use of MMR vaccine plus varicella vaccine.
"We have two very good options," said Jonathan Temte, M.D., Ph.D., a member of the CDC's Advisory Committee on Immunization Practices, or ACIP, and chair of the ACIP MMRV Vaccine Safety Workgroup. "There are some known, though slight, risks with use of the combination product for the first dose at younger ages -- specifically, 12-15 months."

When it was first licensed in 2005, Merck & Co.'s MMRV vaccine, which is marketed as ProQuad, was preferred by the ACIP for both the first and second doses, rather than separate injections of MMR and varicella vaccine.

However, the ACIP issued updated recommendations in February 2008 -- stating no preference for the use of MMRV vaccine versus the two component vaccines -- after preliminary data from two studies showed an increased risk for fever and febrile seizures five-12 days after vaccination among children ages 12-23 months who had received their first dose as the combination MMRV vaccine compared with children who received their first dose as separate injections of MMR and varicella vaccines.

Temte, a professor in the department of family medicine at the University of Wisconsin School of Medicine and Public Health, Madison, said the absolute risk of febrile seizure after measles, mumps, rubella and varicella vaccination is low. However, he said, the relative risk with use of the quadrivalent MMRV vaccine is double that associated with MMR plus varicella in separate injections when administering the first dose to children 12-15 months old.

Data from postlicensure studies do not suggest a similar risk for children ages 4-6 years receiving a second dose. Thus, the ACIP's updated recommendations are as follows:

•For the first dose at age 12-47 months, either the trivalent MMR vaccine and varicella vaccine can be given in separate injections, or the quadrivalent MMRV vaccine may be used. Clinicians considering MMRV vaccine administration should discuss the benefits and risks of both vaccination options with parents. Unless parents express a preference for MMRV vaccine, the CDC recommends that MMR vaccine and varicella vaccine should be administered for the first dose in this age group.
•For the second dose at age 15 months to 12 years, and for the first dose in children ages 4 years or older, use of MMRV vaccine generally is preferred rather than separate injections of MMR vaccine and varicella vaccine. Considerations should include clinician assessment, patient preference and the potential for adverse events.
•Children with a personal or family history of seizures of any etiology generally should be vaccinated with MMR vaccine and varicella vaccine.
Overall, Temte said, the MMRV vaccine is safe and effective. He added that although febrile seizures generally are benign events, they can be extremely worrisome for parents.

The ACIP's recommendations for the use of the quadrivalent vaccine have been moot for the past three years because of the unavailability of ProQuad. Merck notified the CDC about a pending shortage of the vaccine in February 2007 because of lower-than-expected yields of varicella-zoster virus. In May 2007, the manufacturer said it expected that supplies of the vaccine would be depleted within two months.

According to a recent update on the CDC's Current Vaccine Shortages & Delays Web page, Merck planned to begin taking orders for MMRV vaccine beginning May 10. The agency said Merck was expected to have about 1.4 million doses of ProQuad available.

At press time, however, a check of Merck's ProQuad website found that the vaccine was still noted as unavailable.

Allscripts Electronic Health Record Selected by UBMD - June 11, 2010

Allscripts announced that UBMD selected Allscripts EHR solution to help its 450 physicians enhance quality of patient care, improve patient communications, & better manage the cost of care delivery.

"The Allscripts electronic health record will let us develop a single, comprehensive patient record across multiple practices while still enabling our physicians in different specialties to refine and customize the type of information they enter and the way they work," said Michael Quinn, Chief Financial Officer of UBMD, a multispecialty group practice whose 450 physicians are faculty at the University at Buffalo School of Medicine and Biomedical Sciences.

UBMD physicians work in 18 practices across Western New York and also practice at affiliated institutions including Kaleida Health and Erie County Medical Center Corporation. The group will initially implement the Electronic Health Record for 35 physicians and intends to complete the roll out to its physician base within two years.

Streamlined experience for patients

Mr. Quinn continued, "Now each provider in our 18 practices will be able to see what's going on with the patient, which supports our effort to deliver one-stop shopping for patients by referring them to other UBMD providers. It's a streamlined experience for both patients and providers."

UBMD's Internal Medicine division has used the Allscripts Electronic Health Record successfully since 2004. But when UBMD went looking for an enterprise EHR for the full group, they formed a physician-led committee to conduct an exhaustive review of other products on the market.

Research capabilities were critical

"Because we're a research organization as well as a clinical practice, we needed an EHR that could collect, store and retrieve data to support an academic practice," said Peter Winkelstein, M.D., Chief Medical Informatics Officer of UBMD and Chief of the Division of Pediatrics at the Women and Children's Hospital of Buffalo. "Above all, we really needed a product that would be able to collect data coherently and report on it coherently, and Allscripts very rapidly emerged from the herd on that front."

To help with its research efforts, UBMD will deploy Allscripts Analytics, which enables automatic tracking of performance on financial and quality measures - for example, the percentage of all diabetic patients whose blood glucose levels are not controlled - and also provides proactive patient and population management.

Allscripts also satisfied UBMD's other criteria for an enterprise Electronic Health Record - the proven ability to build interfaces with hospital inpatient information systems, and a strong patient portal solution, Winkelstein said.

Allscripts will integrate the Electronic Health Record with UBMD's existing practice management system from GE, and with the inpatient information systems of its teaching hospitals.

Additional Information on ARRA and Meaningful Use

Allscripts has recently deployed a number of resources to help physician practices demonstrate "meaningful use" and take advantage of the American Recovery and Reinvestment Act ( ARRA ), which provides physicians between $44,000 and $64,000 for adopting an Electronic Health Record:

* The Allscripts Stimulus Program provides physicians with a guarantee that the Allscripts Electronic Health Record they select will meet the EHR certification criteria provided by the US Department of Health and Human Services ( HHS ). Meaningful Meaningful Use - June 11, 2010

Quiz:

What does the term “meaningful use” mean?

a. Using something in a way that gives life purpose and leads to carefree days of glee.
b. It depends on your definition of the word “term.”
c. It is not mean. It is really nice.
d. A large number of rules created by the government to assess a practice’s use of electronic medical records so that they can spur adoption, give criteria for incentive rewards, and have physicians in a place where care can be measured.
e. Job security for those making money off of health IT.

The answer, of course is d and e.

Meaningful Use, in the eyes of many is seen as curse words, especially doctors.

Under the plan, physicians will be paid cash dollars for meeting these criteria. Here’s the payment:

•2011 – $18,000 per physician, one-time payment
•2012 – $12,000
•2013 – $8,000
•2014 – $4,000
•2015 – $2,000
•2016 – $0
•2017 – 1% penalty in Medicare payments if you do not qualify.
•2018 and beyond – 2% penalty. More criteria to qualify? More quality measures? More penalties for not meeting criteria? Stricter criteria for A1cs? Other insurance companies using the same criteria or different criteria? More government control is a definite.
So what’s the big deal? Why would doctors be against getting extra money? Here are some of the main reasons:

1.They don’t want to use EMR and feel like the government is forcing them
2.They think the rules are so onerous that it’s hopeless to even try
3.They only like yellow charts, and the blue ones make them feel depressed
4.They see that eventually non-adoption of EMR will be penalized. This makes many conclude that Meaningful Use is just a ploy for the government to cut reimbursement.
I too wish the chart was yellow, but overall I am not upset about all of this. The reason I am not upset is entirely selfish: I have been on EMR for 14 years and use a high-end product, so I will very likely be awarded the full $$ and avoid penalties. I also see this as an opportunity for physicians practicing good care to be seen as good doctors, and the bad ones to actually be penalized instead of rewarded.

You see, I have always seen EMR as much more than a computerized version of the paper chart. The true value in EMR is not that you get to type, it is that all of the information is stored in a single place, organized, and easily retrieved when needed. Using an EMR for documentation alone is like using a car to travel only as fast as you can walk. If payment is not so much based on the quality of my coding and my note-taking, but instead based on the quality of the care I give, isn’t that a good thing? Isn’t that what we should want?

No Patient Left Behind

The devil is in the details. Or, to be more accurate, the devil is in DC. The real problem with meaningful use is the fact that it is a mandate. Mandates like this – the use of testing/criteria by the government to get people to act in a certain way – have a huge flaw. This is best understood with another mandate of the government that has caused it’s own trouble: the No Child Left Behind law of 2001.

The intent of the NCLB law was to improve the quality of education in the US. It established standardized testing to:

1.Set a minimum requirement for education – students cannot be passed-on to higher grades unless they pass the test.
2.Held schools accountable for quality. Schools performing in the lowest range on the standardized testing would be publicly identified and penalized.
3.Teachers with low student scores would be penalized as well.
But the law of unintended consequences has caught up with NCLB, with schools/teachers “gaming” the system, undo focus on test-passage over comprehensive education, and squashing of teacher creativity with fear of low test-scores. Talking to teachers and parents (as a pediatrician), there is very little love for the NCLB law.

And children pay the price of this legislation as well. I saw a child recently who is a very hard worker, a very conscientious child, and who has been able to get mainly B’s in his classes. The problem for him is that he does not take standardized tests well. Despite medication and even allowances made in the testing setting, he fails the test which covers information he has shown in the classroom that he knows. The government calls his school and teacher as the cause of his failure, but he is the one who has to be held back until he’s able to pass the test.

In the same way, making a bunch of criteria for EMR use is sure to have a slew of unintended consequences. Doctors will select EMR systems based on meaningful use criteria, not on how well they work. Doctors will select patients who can get the scores higher and discharge those who probably need the most help.

Sounds familiar.

Meaningful Meaningful Use

What should be done? The real question should be: what can an EMR do to impact patient care that would be truly meaningful? If an EMR improves the ability of the doctor to take care of the patient, that is meaningful. But if the EMR makes the doctor pay more attention to qualifying for the cash payment than to the real care of the patient, it is more meaningless use.

I use an EMR every day. I use it because it helps me give better care and makes our office run more efficiently. If we have a new process that works better by using paper, we use paper. We are not wed to the idea of using computers, we are committed to good process and excellent care. The good news for us is that doing so has made us efficient enough to increase our revenue significantly at the same time that we improve our care quality. That’s what everyone wants.

It really worries me that the imposition of these criteria on EMR will dilute my focus on patients with a focus on achieving meaningful use. This is similar to the experience of many good teachers who had to abandon more creative teaching methods to ensure better test performance. If the criteria are not right, they will do this; there is no question.

So before imposing a set of criteria to be evaluated on doctors, we need to be sure that the criteria themselves are scrutinized. For them to truly improve care and not add more burdens to medical offices, they should:

•Improve doctor/patient communication
•Make information more accessible to doctors and patients
•Capture data automatically, not necessitating extra steps that could distract from care
•Capture data so it can be used for reminders and clinical decision-making at the point of care
•Improve doctor/doctor communication (primary care to specialists and hospitals)
•Capture interventions, not just outcomes. For example, the prescription of a blood pressure medication should be rewarded, not only if the patient takes it. The ordering of a mammogram should be rewarded, not just if the patient gets it done.
•Systems should be required to “close the loop” for interventions, meaning that ordering providers should be alerted to any test, procedure, or consult results that do not come back. This is an enormous problem that frustrates many doctors and patients, increases medical liability, and causes harm. Computers are good at this kind of thing.
I am sure there are more, but my word count is getting high. The bottom line: meaningful use has to be truly meaningful.
