The Impact of Recent HIPAA Changes - July 5, 2010

The Health Information Technology for Economic and Clinical Health (HITECH) Act, part of the American Recovery and Reinvestment Act of 2009, contains a number of changes to the regulations of the Health Insurance Portability and Accountability Act (HIPAA). To remain HIPAA-compliant, speech-language pathologists and audiologists who are "covered entities" (health care providers who conduct certain financial and administrative transactions electronically) should be aware of several HIPAA changes now in effect.

Security Breach Notifications
A covered entity must notify affected individuals following the discovery of a breach of unsecured protected health information (PHI). If a covered entity discovers a breach, it must provide written notice to the individual without "unreasonable delay" and within 60 days after the discovery of the breach. A business associate must follow the same timeline to notify the covered entity when it discovers a breach. Right to Request PHI Restriction
Under HIPAA, an individual has the right to request that the covered entity restrict the use and disclosure of his or her PHI for treatment, payment, or health care operations. Prior to the HITECH Act provisions, a covered entity did not have to agree to a restriction; now, however, if an individual pays for a service out-of-pocket, the covered entity must grant the individual's request for restrictions on the use and disclosure of PHI related to that service for payment or health care operations.

Business Associates
The HIPAA security standards that apply to covered entities also now apply to business associates (individuals or corporations that perform any function involving the use or disclosure of PHI on behalf of the covered entity and are not a member of the covered entity's workforce). Previously, business associates were liable for breach of contract only if they did not comply with certain security requirements included in the business associate agreement. Now, business associates are required to comply with the HIPAA security standards and are subject to the same criminal and civil penalties that apply to covered entities if they do not. These new requirements must be added to the business associate agreement.

Business associates also are required to comply with the privacy obligations outlined in the business associate agreement. If a business associate violates those privacy provisions, the business associate is not only liable for a breach of contract, but also is subject to civil and criminal penalties.

Finally, if a business associate becomes aware that the covered entity has breached its obligations under the business associate agreement, the business associate must take steps to cure the breach. If this is not possible, the business associate must then either terminate the agreement or report the covered entity to the Department of Health and Human Services. (The covered entity already has the same obligation regarding a business associate's breach of the agreement.) The business associate agreement should be amended to reflect this new obligation.

Small physician practices inch closer to adopting electronic health records - July 5, 2010

After dismissing it as too expensive for years, doctors in small or solo practices are now closely evaluating their options to buy sophisticated electronic medical record-keeping systems due to a combination of government pressures and new products in the market.

However, independent physicians remain in a tough spot — knowing there are strong incentives to make the switch, but nervous about such a large investment in a software system during tough times, particularly when the options are tough to sort through.

“You’ve got to start doing something, but who knows which is the right one?” said Dr. Stephen Rockower, a partner in Capitol Orthopaedics & Rehabilitation LLC, a four-doctor practice in North Bethesda. “I tend to be one of the more computer-savvy people out there, and you know, I’m confused.”

Vendors have quoted prices from $24,000 to $120,000, and “they basically all look the same,” he said.

The federal economic stimulus package contains $19 billion in incentives for doctors who demonstrate “meaningful use” of electronic records by late 2011.

That’s the carrot. But a stick is coming too. Doctors will see penalties in government-funded insurance reimbursements if they haven’t gone paperless by 2015.

Health policy researchers and politicians have long argued that replacing paper charts with searchable, shareable databases could radically pare medical errors and shave significant costs. But with price tags in excess of $100,000 and a laborious implementation, physicians outside all but the largest group practices simply ignored it until recently.

On June 15, GE Healthcare unveiled a product specially designed for small practices. Records can be stored on GE’s own servers and are accessible through a low-tech Internet interface, decreasing the upfront costs.

In May, Adventist HealthCare of Rockville announced price deals with two computerized records manufacturers, eClinicalWorks and Allscripts, and said it will offer $200 monthly subsidies to medical staff doctors who buy them.

Part of the stimulus package included a one-time exception to the Stark laws, a maze of federal regulations limiting the financial arrangements between doctors and hospitals, to allow the subsidies.

After the $200 monthly subsidy from Adventist, doctors would face monthly fees between $300 and $500 to buy the systems. Chief Medical Officer Gaurov Dayal said the program, which should be up and running for a few doctors by August, will jump-start the integration of doctor and hospital records.

Dr. Robert Karp, president of the Montgomery County Medical Society and a cosmetic surgeon in Rockville, said small practices are beginning to face reality: Electronic records are a must.

“I believe eventually I will do this,” he said. If you’d asked me that a year ago, I would have said, ‘No, I’m not going to do it.’”

But physicians still have numerous concerns. The most expensive systems are completely unrealistic for financially unstable practices, Karp said, even with the government incentives. Also, there’s no guarantee that vendors today will be in business over the life of the product or that it will meet federal standards for “meaningful use.”

However, there’s a tremendous drumbeat from medical consumers and payers to force the transition. In April, the Consumers Union, AARP, the National Retail Federation and others wrote a letter to Health and Human Services Secretary Kathleen Sebeilius, urging her to reject requests from some medical groups to slow down the implementation timeline.

Early adapters
The 2009 federal stimulus package included $19 billion in Medicare and Medicaid funding for doctors and hospitals that switch over to electronic health records, with the most money available for those who quickly show “meaningful use” of a new software package.

Medicare EHR incentives: Doctors can receive up to $18,000 if they demonstrate “meaningful use” of the new technologies by 2011 or 2012 and can eventually earn as much as $44,000 over a six-year span. Doctors who don’t qualify until 2013 are capped at $39,000, those who qualify in 2014 are capped at $24,000, and physicians who start in 2015 or later will receive nothing. In 2015, doctors who don’t use electronic records are subject to a cut in normal Medicare payments.


Medicaid EHR incentives: The incentives are voluntarily administered by states, which might not start their programs as quickly as the federal Medicare program. Eligible doctors can receive up to $21,250 in their first year with electronic medical records, and $8,500 in each of the following five years for a total of $63,750. To qualify for these payments instead of the Medicare program, doctors’ patient loads must be at least 30 percent Medicaid funding (or 20 percent for pediatricians).

Hospitals are faced with similar incentives and penalty schedules, which will be determined through a formula considering patient volume.

Big Breach at Anthem Blue Cross - June 25, 2010

Anthem Blue Cross, the trade name for Blue Cross of California, is notifying about 230,000 members and applicants for insurance that a Web site used to apply for individual health insurance policies was breached.

The insurer says attorneys working on a class action lawsuit were able to access medical information and credit card and Social Security numbers, among other information, because all security mechanisms were not reinstated following an October 2009 upgrade.

An attorney representing affected individuals told the Associated Press that the information was not secure for five months. What follows is a statement that Anthem Blue Cross has issued:

"Anthem Blue Cross is committed to protecting the privacy and security of our members' and applicants' personal information, in accordance with all applicable laws and regulations.

"We recently learned of a situation in which a small number of individuals manipulated the web address (URL) within the web site we use to allow people applying for individual insurance to track the status of their insurance applications. Through this manipulation, some of these individuals gained unauthorized access to certain private information. The vast majority of such manipulation and the resulting unauthorized access occurred at the hands of certain attorneys (representing an applicant). We believe that this manipulation was conducted to support a class action against Anthem Blue Cross and/or its parent company - over the very breach being committed.

"The ability to manipulate the web address (URL) was available for a relatively short period of time following an upgrade to the system. After the upgrade was completed, a third party vendor validated that all security measures were in place, when in fact they were not. As soon as the situation was discovered, we made the necessary security changes to prevent it from happening again.

"We have requested both by letter and in court filings that the attorneys return all information improperly obtained from the individual application system and as a result, that information has been delivered to a court approved custodian who will ensure its security.

"We have worked since discovery of this matter to analyze the data in an effort to identify all individuals whose information may have been impacted and prepared to communicate directly to affected members and applicants as soon as possible. As stated above, all information acquired by the attorneys has been transferred to the court's custodian and beyond that, we have received no indication that any other information accessed has been used inappropriately.

"Out of abundance of caution, all appropriate applicants will receive a detailed notification from Anthem Blue Cross explaining what happened, and will be offered identity protection services for one year at no cost.

"We are currently weighing our legal options with respect to the data, the impact - if any - on our members, and the remediation costs incurred as a result of these actions."

Bumenthal: Certified EHRs should be available by fall - June 25, 2010

The health IT community should know by this fall if EHRs they have purchased or are considering purchasing are certified under the federal government's new, temporary certification program, national health IT coordinator Dr. David Blumenthal said, according to Healthcare IT News. Blumenthal made the pronouncement on a conference call with reporters after unveiling the final rule for a short-term certification program last Friday.

Vendors may be cutting it close, though, since the Medicare and Medicaid bonuses for "meaningful use" of EHRs begin Oct. 1 for hospitals and Jan. 1 for physicians. However, providers will only have to demonstrate meaningful use for 90 consecutive days to earn full credit for the first year of the program, according to proposed rules. CMS is expected to finalize its regulations for meaningful use within the next week.

"Certification was part and parcel of the process of making incentives work, and making the electronic health system work," Blumenthal said. "Certification provides a basic guarantee to the purchasers--mostly providers of care--that the electronic health record they purchase will be capable of meaningful use."

The temporary program is intended to be "a bridge to the second, permanent certification," Blumenthal said. The permanent process should be announced before the end of 2010, he said.

The Office of the National Coordinator for Health Information Technology will begin accepting applications July 1 for entities wishing to be authorized testing and certification bodies. The Certification Commission for Health Information Technology announced its intention to apply, and the Austin, Texas-based Drummond Group also has expressed an interest in starting an EHR certification program.

Surgeon Sentenced to Jail Following HIPAA Violation - June 25, 2010

While warnings about heightened penalties for HIPAA violations proliferated following last year’s passage of the Health Information Technology for Economic and Clinical Health Act (HITECH), one California physician apparently failed to take notice.

Huping Zhou, a licensed cardiothoracic surgeon who was previously working at the UCLA School of Medicine as a researcher, was sentenced in late April to four months of jail after pleading guilty to improperly accessing patient medical records. Zhou’s sentence marks the first incarceration for security breaches under the heighted HITECH penalties.

In light of the enhanced penalties, health care providers should make sure that all employees understand HIPAA rules and regulations, and are aware that any unauthorized access to patient files constitutes a HIPAA violation. While “file snooping” is most prevalent when the patient is a celebrity, employees may also be tempted to peek at files for their neighbor, child’s teacher, or other acquaintances. While employees may believe they are permitted to view such records, access to protected health information must be for treatment, payment, or health care operations. Therefore, perusing a patient’s file out of curiosity is not an authorized access and can land a practice in hot water.

The American Medical Association advises practices to conduct credit checks and other background searches on potential employees prior to hiring and instatement. For example, if a practice treats many celebrities, the practice should be wary of hiring an employee who has a lot of debt or a low credit score, as the employee may be tempted to sell the information to tabloids or newspapers.

Paperless in Orlando Florida.....the Movement Continues - June 24, 2010

Orlando Florida -- Meera Sutaria of Ashburn grew tired of trying to read the scribbled handwriting from the mounds of patient documents. So when she opened her optometry practice, she left behind the clutter and waste of paper from her former employer.

In the office that she opened in December, even the standard paper eye chart has been replaced with a wall-mounted digital projector that sits behind the patient and reflects letters from an eye test against a facing mirror.

"Our whole office is paperless. That was kind of a no-brainer decision for me," said Sutaria, who graduated from the Pennsylvania College of Optometry at Salus University in 2007.

That decision has put her Brambleton business, InSight Eye Optique, at the forefront of a national agenda to better utilize information technology in the health-care industry.

When President Obama signed the American Recovery and Reinvestment Act last year, the statute included a provision that each person in the United States should have an electronic medical record by 2014.

A survey released in December by the Centers for Disease Control and Prevention, however, reported that fewer than half of the office-based doctors who participated used an electronic medical-record system. Critics said the plan and its aggressive timeline could make it more difficult to use health-care information technology.

David Blumenthal, who heads the Office of the National Coordinator for Health Information Technology, said that he understands concerns about putting health-information technology into practice but that the success of the initiative relies on health-care professionals participating.

"The success of this health [information technology] journey depends on people: people who are passionate about improving patient care, and who are supported in making those improvements," he said in a statement.

Although investing in technology can be a sizable endeavor for medical practices with years of service, Sutaria said, it will benefit patients.

Her business features a retreat room where a patient can relax in an automated massage therapy chair before an appointment or after having pupils dilated. Fruit- and vegetable-based beverages that could help stimulate eye health are offered.

By using a digital-refraction system, a device that measures prescriptions for eyeglasses or contact lenses, that is integrated with a patient's medical information, Sutaria said, she is able to compare the effectiveness of a prescription and change it, if necessary, without significant delay.

The device is controlled by a wireless keypad and can instantly switch between prescriptions and recall a patient's prescription history within seconds. Sutaria said patients notice the difference immediately.

"They're more likely to get that new pair of glasses," she said, because they see better.

Sutaria said the increased efficiency has allowed patients to spend more time with her than waiting for service. She also reduced the errors and delays that stockpiling handwritten documents caused at her former employer's.

"I don't know what it'd be like to go back," she said. "I'd probably hate it."

EMR Consultancy ImplementHIT Positions St.Vincent Health to Achieve Cost Savings & Federal Stimulus Incentives - June 23, 2010

LOS ANGELES - (Business Wire) ImplementHIT, a consulting group specializing in empowering hospitals and large physician practices to implement electronic medical records (EMR) systems, announced today that, following successful implementation of AllscriptsTM Enterprise EHR v11, they are beginning the second phase and ongoing online training at St.Vincent Health. A nonprofit health care system, St.Vincent is sponsored by Ascension Health, the largest Catholic health system in the nation. It is Indiana's largest healthcare employer, with 16 hospitals serving 45 counties in central Indiana.

ImplementHIT possesses unparalleled expertise with Allscripts EHR systems, including the latest Enterprise EHR v11. In June 2009, ImplementHIT was selected to help St.Vincent move the entire organization of nearly 300 providers from Allscripts EHR Version 10 to Enterprise EHR v11. St.Vincent recognized this rollout would require significant specialized support and configuration to be functional in their environment. They also required an effective training solution that would protect physician productivity and drive adoption. Physician adoption would lead to cost savings, increased productivity and attainment of federal financial ARRA stimulus incentives.

This project included subsequent integration of the sophisticated and complex v11 Note module. To ensure physicians utilized the full power of this EMR, ImplementHIT leveraged their online training platform to develop custom training that conformed to St.Vincent’s workflows.

“This Allscripts EHR is very complex,” said Margaret S. Cornwell, RDMS, PMP, Manager of the Allscripts Team for St.Vincent Health. “With the Note module in particular, I believe we’re ahead of the industry with what we’ve designed,” she said.

With ImplementHIT, St.Vincent has reduced their training time requirements by 30 percent in the first phase, enabling physicians to focus on treating patients. For St.Vincent this was critical because physicians can continue generating revenue by staying in the clinic instead of leaving for more training. Physicians have been able to participate in ImplementHIT’s online training when most convenient for them and outside of clinic hours. With ImplementHIT, they transitioned from a 100 percent onsite instructor-led live training session to a hybrid approach that incorporates online learning. This hybrid learning program leverages the best of onsite training for specific educational objectives with the online component customized to their configurations and workflows and the specialty-specific context of the learner.

St.Vincent is on track to demonstrate meaningful use to access federal ARRA stimulus incentive funding. In addition to measuring the effectiveness of the training program by the learner’s ability to achieve meaningful use, satisfaction scores from learners, and assessments by onsite support personnel have demonstrated a significant benefit. Physicians have found the training convenient and practical prior to go-live. Physician trainers note that onsite training has become far more efficient because learners have a foundation of prior knowledge. EHR support staff report physicians are better capable of achieving pre-implementation patient volumes in less time during go-live support. Because physicians generate revenue by staying in the clinic, St.Vincent has realized a savings of over $6 for every $1 invested into the training solution.

With this rollout successful, ImplementHIT will implement a second phase of online training based on their patent-pending technology. This will further reduce the online training time a projected 50 percent, and help St.Vincent achieve meaningful use of Allscripts Enterprise v11. More details on this technology will be available when it is approved by the U.S. Patent and Trademark Office.
