EMR Stimulus Questions and Answers - June 4, 2010

One of the challenges of this blog is writing content that will be interesting and useful to a wide variety of readers. At times I think I assume that those visiting EMR and HIPAA have read my 770 previous posts and should have a good understanding about the EMR world.

Of course, the reality is that many of the people visiting this site might only read a couple different posts. Even more significant is that they might only have a remedial understanding of EMR and in particular the EMR stimulus money. This leaves me with the challenge of keeping the long time readers interested and benefiting from the content I create while still helping the EMR newbies understand what they need to know.

In that vein, here’s some questions that I got in an email about meaningful use and the EMR stimulus. Those of you well versed in the EMR stimulus can go and enjoy EMR and EHR or add some content to the EMR wiki while I do what I can to answer.

Are there governing bodies that have been set up to “certify” EMR/EHR software vendors?
Not yet. The government hasn’t recognized any bodies that will certify EMR/EHR per the ARRA requirements. They’ve published some guidelines and rules for those bodies, but HHS has yet to recognize any of them as official ARRA EMR Stimulus certifying bodies. I expect by end of summer we’ll have a couple to choose from. The Drummond Group and CCHIT are both planning to be EHR certifying bodies, but neither has been officially recognized yet.

Do EMR/EHR software vendors have to be “certified”? If they are not “certified”, does this prevent their customers from receiving federal money?
In most cases the EMR/EHR software vendor is the one that will be certified. There has been some provisions and discussions about allowing for 2 other EHR certification options beyond just using a “fully certified EHR” software.

The first is that you could use a combination of certified software vendors. For example, you might use one certified EMR vendor for everything but ePrescribing and then you’ll choose another software vendor who is only certified for the ePrescribing portion. It seems that this type of combo certification will be allowed.

The second is what’s been called a site certification. This would essentially be where a specific site (or location) would be certified against the EHR certification criteria. This is best illustrated by a hospital or clinic which has their own home grown EMR software. This EHR site certification would allow them to certify their site and give them access to the EMR stimulus money. It’s possible that an option like this won’t be available, but from what I can tell it’s looking like it will happen.

Do you think that it is possible to satisfy the Stage 1 objectives?
This is a loaded question. The short answer is that everything is possible. Whether it’s possible or not is not as important as whether doctors will do it or not. This question is hard to answer right now. Mostly because we’re missing a lot of the practical meaningful use details which doctors need to know in order to make a decision.

My gut feeling tells me that it will go about like PQRI stimulus money. Some will get the EMR stimulus and be happy. The same number will try for it and be really disappointed by the whole process. More will say it’s just not worth my time right now. That’s not to say that many of these doctors won’t (or shouldn’t) implement an EMR. I think many of them will, but they’ll do it for the inherent benefits of EMR software and not for the EMR stimulus money.

Finding the Meaning in Meaningful Use - June 4, 2010

In an effort to promote quality, safety, and efficiency through electronic health record (EHR) technology, the Centers for Medicare and Medicaid Services have proposed language defining meaningful use of EHR technology. This new technology is designed to enhance EHR systems with clinical decision support that helps healthcare professionals with drug lists, medication dosing, medication interactions, dosage range checking, and dosage administration.

To be considered a meaningful user of an EHR system three basic requirements must be met: use a certified EHR in a meaningful manner; the EHR is connected to allow for electronic exchange of health information for improving the quality of patient care; and the submission of clinical quality measures.

As EHR vendors continue to make progress on the meaningful use of EHR, new definitions of the term will certainly be introduced.

EHSI Reduces Medication Errors with New iPhone App - June 4, 2010

Emerging Healthcare Solutions, Inc., a medical company seeking to bring cutting-edge medical technologies to today's market, has just revealed that it is developing an innovative new app for the iPhone (News - Alert) that aims at helping senior citizens commit fewer medication errors.




Many seniors in America take a wide range of medicines to maintain their health. Unfortunately, many of them confuse administration and dosage times, and/or forget to take these medications altogether. The cutting-edge Auto-Med app is being created to help users overcome these problems by calling them daily and reminding them of the medicine and exact dosage at the exact time that they need to take their medicine.

This application is expected to be ready for release within 60 days. EHSI is to offer the app on a subscription basis for $10 monthly in order to cover the costs of phone calls and other needed services. The company is targeting 1,000,000 subscribers for this new service within the first year of its launch.

EHSI President and COO Cindy Morrissey observed that over the last few years, amazing developments in medication have taken place that have served to improve the situation of seniors. However, she added, every drug has two things in common. If not taken it will do no one any good, and if taken incorrectly it might harm and even kill those who do so. EHSI's new Auto-Med system can help by calling users at preset schedules daily in order to provide precise reminders regarding what to take, how much of it, and when exactly. She concluded that such a service could reduce frustration, improve safety and health, and save lives as well.

Last year, consumers spent $2.4 billion on iPhone apps, a figure that is expected to triple over the next three years. Fully 34 million iPhone users are connected to the system. Consequently, EHSI believes that Auto-Med could thus be able to enjoy wide acceptance in this market.

The iPhone, produced by Apple, Inc., is a portable data device that permits users to download and install applications that allow it to provide them with additional services. The iPhone competes with the Blackberry phones produced and sold by Research in Motion and with the various smartphones running the Android (News - Alert) operating system, a product of Google, Inc. Laptop Breaches Hit Hospital, Hospice - June 2, 2010

Cincinnati Children's Hospital Medical Center and Park Ridge, Ill.-based Rainbow Hospice and Palliative Care have in recent days publicly notified the media and affected patients of the theft of laptops containing protected health information.

The laptop from Children's Hospital was stolen from an employee's personal vehicle at home between May 27th and May 29th. It contained information on 61,027 patients, including names, medical record numbers, and services received. It did not contain Social Security, debit/credit card or telephone numbers. The hospital has no indication that information has been misused.

Affected patients and their families are being offered a year of free identity protection services. The laptop was password protected but not encrypted; the hospital now is encrypting its other laptops.

In another data breach, an encrypted laptop belonging to Rainbow Hospice was stolen on April 12 during a nurse visit to a patient's home. It contained such information as name, address, date of birth, Social Security number, insurance information, medications, diagnoses and treatments.

While data was encrypted with no indication that it has been accessed, the hospice has notified affected patients and is offering free identity protection services. The hospice has not released the number of affected patients.

The breach notification rule authorized under the HITECH Act does not require notification when affected data is encrypted or otherwise unusable, unreadable or indecipherable because of destruction.

7 Steps To NPI For HIPAA-Compliant Electronic Medical Billing Software And Service - June 2, 2010

The Administrative Simplification provisions of the Health Insurance Portability and Accountability Act of 1996 (HIPAA) mandated the adoption of standard unique identifiers for health care providers, as well as the adoption of standard unique identifiers for health plans. They become mandatory on May 23, 2007.

The purpose of these provisions is to improve the efficiency and effectiveness of the electronic transmission of health information. The Centers for Medicare & Medicaid Services (CMS) has developed the National Plan and Provider Enumeration System (NPPES) to assign these unique identifiers.

CMS has contracted with Fox Systems, Inc. to serve as the NPI Enumerator. The NPI Enumerator is responsible for dealing with health plans and providers on issues relating to unique identification.

HCFA Timetable

Changes in the HCFA 1500 form to accommodate the NPI number took place January 1, 2007. Until March 30, 2007, using NPI number on the HCFA form is optional but as of April 2, 2007, using NPI becomes mandatory.


Getting an NPI is free – Not Having One Can Be Costly: If you delay applying for your NPI, you risk your cash flow.

Enumerate: Enumeration is mandatory for both individual providers and organizations and subparts. When applying for your NPI, CMS urges you to include your legacy identifiers, not only for Medicare but for all payors. If reporting a Medicaid number, include the associated State name. This information is critical for payors in the development of crosswalks to aid in the transition to the NPI.

Update: Make sure to upgrade your software, HIPAA Transactions, CMS1500, UB04, and/or Dental claim form changes.

Communicate: Notify your payers once you have obtained your NPI number. As outlined in the Federal Regulation (The Health Insurance Portability and Accountability Act of 1996 (HIPAA)) you must also share your NPI with other providers, health plans, clearinghouses, and any entity that may need it for billing purposes — including designation of ordering or referring physician.

Collaborate: Check the readiness of your payment partners (such as health plans, TPAs, clearinghouses, etc…)? Not all payers are ready to accept the NPI number at this time. Use both your existing (legacy) number and the NPI number when submitting electronic claims.

Test: Test transactions well before the deadline. Make sure to test HIPAA Transactions, e.g., 837 Claims, 835 Remittance Advice, and, if you submit paper claims, verify that the data is printed in the correct fields. The new HCFA form has new fields for identifier numbers on lines 17b, 32a and 33a.

Educate: Focus on staff working on insurance verification of eligibility and claim denial or underpayment follow up.

Implement: Once you obtain your NPI, it might take about 120 days to do the remaining work to use it. This includes working on your internal billing systems, coordinating with billing services, vendors, and clearinghouses, testing with payers.

The term “meaningful use” came to the public’s attention in the HITECH provisions of the American Recovery and Re-investment act of 2009.(1) It was further defined by the Center for Medicare and Medicaid Services in a way that describes the use of health information technology for use among professionals. In order for eligible providers and hospitals to qualify for federal stimulus dollars under this act, they must must use certified electronic health technology in order to measure clinical quality. The United States federal government outlined the proposed criteria to achieve meaningful use in the Medicare and Medicaid Programs; Electronic Health Record Incentive Program; Proposed Rule of January 13, 2010.(2) Even though the specific details are still in the proposed stage, the effect has been dramatic. Most health care organizations are trying to achieve meaningful use although there are struggles.(3,4) The 25 measures involved in using health information technology for physicians, are separated into 5 initiatives. In order to qualify for stimulus dollars, the eligible provider must meet all the targets specified in the rule during a 90 day reporting period

First Initative . Improve quality, safety, efficiency, and reduce health disparities.

1. Use CPOE for all orders for 80% of orders
2. Enable drug based alerts
3. Maintain an up-to-date problem list of current and active diagnoses for 80% of patients
4. E-prescribe for 75% of prescriptions
5. Maintain an active medication list for 80% of patients
6. Maintain an active allergy list for 80% of patients
7. Record structured demographic data for 80% of patient
8. record vital signs in the EMR for 80% of patients
9. Record smoking status of 80% of patients
10. Incorporate laboratory testing as structured data 50% of the time
11. Generate a list of patients for quality improvement or outreach
12. Report ambulatory quality data to the Center for Medicaid and Medicare services
13. Send reminders to patients per their preference for 50% of patients
14. Implement 5 clinical decision support rules
15. check insurance eligibility electronically for 80% of patients
16. Submit claims electronically for 80% of patients
Second initiative. Engage patients and their families

17. Provide 80% of patients who request it, a copy of their health information within 48 hours
18. Provide 10% of all patients with electronic access to to their health data within 96 hours of its availability.
19. Provide 80% of patients a clinical summary of their visit
Third initiative. Improve care coordination

20. Demonstrate the ability to electronically share clinical information between organizations
21. Perform medication reconciliation for 80% of encounters
22. Provide a summary of care record for 80% of referrals and transitions in care
Fourth initiative. Improve Population and Public Health

23. Demonstrate electronic submission of immunization to state immunization registries
24. Demonstrate the ability to exchange information with public health agencies
Fifth Initiative. Ensure Adequate Privacy and Security Protections for Personal Health Information

25. Protect electronic health information by implementing appropriate technologies.
The interim rule goes on to state that physicians will be required to report on a subset of 90 clinical quality measures related to specialty.(5) The exact quality measures to be selected, and modifications to the use metrics will be available late in the spring of 2010 when the final rule is published.

Blumenthal Offers Meaningful-use Approaches - June 2, 2010

David Blumenthal, head of the Office of the National Coordinator for Health Information Technology at HHS, took to e-mail and the Web last week to get the word out about an alternative way for providers to communicate to meet federal meaningful-use requirements and qualify for billions of dollars in health IT payments.

The American Recovery and Reinvestment Act of 2009, also known as the stimulus law, requires that providers must meaningfully use an electronic health-record system to qualify for up to an estimated $27.3 billion in federal reimbursements.

Last December, the CMS, which will administer the EHR funding under the Medicare and Medicare Advantage programs, issued a proposed rule defining the meaning of meaningful use. Congress, however, mandated three meaningful-use criteria that providers must meet—electronic prescribing, reporting quality measures to HHS and exchanging information electronically to improve patient care.

As proposed, the nationwide health information network will be capable of handling all three mandated transactions. However, as originally contemplated, the NHIN was to be a “network of networks,” reliant on local, regional or statewide exchanges to serve as on-ramps to the NHIN.

With the clock running down on the start of the stimulus law funding program—the first “payment year” for the Medicare portion of the plan begins Oct. 1—and with only a limited number of the exchanges up and running, the government came up with an alternative method of peer-to-peer connection called NHIN Direct so that providers without access to an exchange or the techno-savvy to use it could still meet the meaningful-use criteria and qualify for EHR payments.

“To make meaningful use possible, including the necessary exchange of information, we need to meet providers where they are, and offer approaches that are both feasible for them and support the meaningful-use requirements of the Centers for Medicare & Medicaid Services Electronic Health Record Incentives Programs,” Blumenthal wrote on May 14. “As with the Internet, it is likely that what is today considered ‘highly sophisticated' will become common usage. Moreover, users may engage in simpler exchange for some purposes and more complex exchange for others.”

There are examples of the NHIN's “high level of interoperable health information exchange,” Blumenthal said, specifically touting work in this area by the Defense Department, Social Security Administration, Veterans Affairs Department, Kaiser Permanente and MedVirginia, which “came together to show, on a pilot scale, that this type of highly evolved exchange was possible.

“Having succeeded, they continue to expand the level of exchange among their group and with their own respective partners in a carefully phased way to demonstrate and learn from these widening patterns of exchange,” he said.

Using the standards, services and policies that constitute the NHIN, these pioneers are using the system for what Blumenthal describes as “robust exchange,” including finding and accessing patient information among multiple providers, supporting the exchange of information using common standards; and documenting trust agreements between participants, such as Data Use and Reciprocal Support Agreements.

However, Blumenthal said, not every organization or provider “needs or is ready for this kind of health information exchange today. Nor do the 2011 meaningful-use requirements set forth by CMS in the recent proposed rule require it. Direct, securely routed information exchange may meet the current needs of some providers for their patients and their practices, such as receiving lab results or sending an electronic prescription.”

That's where NHIN Direct comes in.

Still under development by HHS, the NHIN Direct Project is a set of open-source software and standards aiming “to create a means for direct electronic communication between providers, in support of the 2011 meaningful-use requirements.”

While NHIN Direct remains a work in progress, Blumenthal said, “We are on an aggressive timeline to define these specifications and standards and to test them within real-world settings by the end of 2010. Timing is critical so that we may provide this resource to a broader array of participants in health information exchange as a wave of new, meaningful users prepare to qualify for incentives provided for in the HITECH Act and ultimately defined by CMS.”

“It is meant to enhance, not replace, the capabilities offered by other means of exchange,” Blumenthal said, adding that an example of an NHIN Direct transaction would be sending an electronic referral letter along with a patient-care summary from a primary-care physician to a specialist.

Blumenthal also issued a call for help and participation in developing and using the new, peer-to-peer channel.

“The NHIN Direct Project will conduct an open, transparent and collaborative process throughout its development by using a community wiki, blogs and open-source implementation already available on the project's website,” he said. “I encourage you to participate through the website, via public participation at the implementation group meetings, and by deploying and testing the resulting standards and specifications.”

No Meaningful Use Without Meaningful Measures - June 2, 2010

Orlando Florida --

Last January, the Office of the National Coordinator for Health Information Technology (ONCHIT) published the Notice of Proposed Rule (NPRM) which provided further definition of "Meaningful Use" and outlined the specific health IT functional measures and clinical quality measures for Stage I compliance. During the subsequent comment period, concerns were expressed by providers, vendors and other parties highlighting the fact that collecting and producing the required measures could be as challenging as implementing the software capabilities.

I believe the respondents concerns are well founded. For decades healthcare software vendors have focused on the automation of specific tasks and workflows while reporting and metrics were treated as a byproduct or the "exhaust" of the healthcare computing process. The result was a tremendous amount of "data noise" with limited content to let decision-makers at all levels understand where the organization stood and what actions were needed. To remedy the situation, extensive manual processes and spreadmarts were implemented to produce the reports needed by senior executives. To be fair, some HIT vendors recently begun to recognize that their customers need better reporting tools and have expanded their reporting capabilities but there is still a lot of work to be done.

On May 17th, the Centers for Medicare and Medicaid Services (CMS) awarded Northrop Grumman a $34M contract to develop a National Level Repository database to process HITECH incentive payments. This database will store informatin about whether medical professionals and hospitasl are meaningful users of electronic health records, the date and amount of any incentive payments made to them and their tax identification number. It will serve as a key component of CMS' infrastructure to collect, analyze and act on the data submitted by providers and will evolve as subsequent HITECH reporting requirements evolve.

While the term "Meaningful Use" has recently become in vogue, many leading healthcare providers have been investing in physician adoption, clinical excellence, and informatics for several years. These pacesetters recognize that improving the quality of cost-effective care is impossible without the ability to capture and act intelligently on quality management and clinical information. Many of these same providers also understand that the primary reason for pursuing these goals is to improve the quality and delivery of cost-effective care while the HITECH incentives are merely a temporary facilitator. As government and payers collect additional information, providers must become more adept at using clinical and performance measures if they are to survive.

As Meaningful use requirements continue to evolve, it is clear that providers will need the data infrastructure and business intelligence capabilities in place in order to measure, monitor, act on, and submit the required measures. Just as demonstrable excellence in care delivery requires measurable results, there is "no Meaningful Use without meaningful measures".
