Big Breach at Anthem Blue Cross - June 25, 2010

Anthem Blue Cross, the trade name for Blue Cross of California, is notifying about 230,000 members and applicants for insurance that a Web site used to apply for individual health insurance policies was breached.

The insurer says attorneys working on a class action lawsuit were able to access medical information and credit card and Social Security numbers, among other information, because all security mechanisms were not reinstated following an October 2009 upgrade.

An attorney representing affected individuals told the Associated Press that the information was not secure for five months. What follows is a statement that Anthem Blue Cross has issued:

"Anthem Blue Cross is committed to protecting the privacy and security of our members' and applicants' personal information, in accordance with all applicable laws and regulations.

"We recently learned of a situation in which a small number of individuals manipulated the web address (URL) within the web site we use to allow people applying for individual insurance to track the status of their insurance applications. Through this manipulation, some of these individuals gained unauthorized access to certain private information. The vast majority of such manipulation and the resulting unauthorized access occurred at the hands of certain attorneys (representing an applicant). We believe that this manipulation was conducted to support a class action against Anthem Blue Cross and/or its parent company - over the very breach being committed.

"The ability to manipulate the web address (URL) was available for a relatively short period of time following an upgrade to the system. After the upgrade was completed, a third party vendor validated that all security measures were in place, when in fact they were not. As soon as the situation was discovered, we made the necessary security changes to prevent it from happening again.

"We have requested both by letter and in court filings that the attorneys return all information improperly obtained from the individual application system and as a result, that information has been delivered to a court approved custodian who will ensure its security.

"We have worked since discovery of this matter to analyze the data in an effort to identify all individuals whose information may have been impacted and prepared to communicate directly to affected members and applicants as soon as possible. As stated above, all information acquired by the attorneys has been transferred to the court's custodian and beyond that, we have received no indication that any other information accessed has been used inappropriately.

"Out of abundance of caution, all appropriate applicants will receive a detailed notification from Anthem Blue Cross explaining what happened, and will be offered identity protection services for one year at no cost.

"We are currently weighing our legal options with respect to the data, the impact - if any - on our members, and the remediation costs incurred as a result of these actions."

Bumenthal: Certified EHRs should be available by fall - June 25, 2010

The health IT community should know by this fall if EHRs they have purchased or are considering purchasing are certified under the federal government's new, temporary certification program, national health IT coordinator Dr. David Blumenthal said, according to Healthcare IT News. Blumenthal made the pronouncement on a conference call with reporters after unveiling the final rule for a short-term certification program last Friday.

Vendors may be cutting it close, though, since the Medicare and Medicaid bonuses for "meaningful use" of EHRs begin Oct. 1 for hospitals and Jan. 1 for physicians. However, providers will only have to demonstrate meaningful use for 90 consecutive days to earn full credit for the first year of the program, according to proposed rules. CMS is expected to finalize its regulations for meaningful use within the next week.

"Certification was part and parcel of the process of making incentives work, and making the electronic health system work," Blumenthal said. "Certification provides a basic guarantee to the purchasers--mostly providers of care--that the electronic health record they purchase will be capable of meaningful use."

The temporary program is intended to be "a bridge to the second, permanent certification," Blumenthal said. The permanent process should be announced before the end of 2010, he said.

The Office of the National Coordinator for Health Information Technology will begin accepting applications July 1 for entities wishing to be authorized testing and certification bodies. The Certification Commission for Health Information Technology announced its intention to apply, and the Austin, Texas-based Drummond Group also has expressed an interest in starting an EHR certification program.

Surgeon Sentenced to Jail Following HIPAA Violation - June 25, 2010

While warnings about heightened penalties for HIPAA violations proliferated following last year’s passage of the Health Information Technology for Economic and Clinical Health Act (HITECH), one California physician apparently failed to take notice.

Huping Zhou, a licensed cardiothoracic surgeon who was previously working at the UCLA School of Medicine as a researcher, was sentenced in late April to four months of jail after pleading guilty to improperly accessing patient medical records. Zhou’s sentence marks the first incarceration for security breaches under the heighted HITECH penalties.

In light of the enhanced penalties, health care providers should make sure that all employees understand HIPAA rules and regulations, and are aware that any unauthorized access to patient files constitutes a HIPAA violation. While “file snooping” is most prevalent when the patient is a celebrity, employees may also be tempted to peek at files for their neighbor, child’s teacher, or other acquaintances. While employees may believe they are permitted to view such records, access to protected health information must be for treatment, payment, or health care operations. Therefore, perusing a patient’s file out of curiosity is not an authorized access and can land a practice in hot water.

The American Medical Association advises practices to conduct credit checks and other background searches on potential employees prior to hiring and instatement. For example, if a practice treats many celebrities, the practice should be wary of hiring an employee who has a lot of debt or a low credit score, as the employee may be tempted to sell the information to tabloids or newspapers.

Paperless in Orlando Florida.....the Movement Continues - June 24, 2010

Orlando Florida -- Meera Sutaria of Ashburn grew tired of trying to read the scribbled handwriting from the mounds of patient documents. So when she opened her optometry practice, she left behind the clutter and waste of paper from her former employer.

In the office that she opened in December, even the standard paper eye chart has been replaced with a wall-mounted digital projector that sits behind the patient and reflects letters from an eye test against a facing mirror.

"Our whole office is paperless. That was kind of a no-brainer decision for me," said Sutaria, who graduated from the Pennsylvania College of Optometry at Salus University in 2007.

That decision has put her Brambleton business, InSight Eye Optique, at the forefront of a national agenda to better utilize information technology in the health-care industry.

When President Obama signed the American Recovery and Reinvestment Act last year, the statute included a provision that each person in the United States should have an electronic medical record by 2014.

A survey released in December by the Centers for Disease Control and Prevention, however, reported that fewer than half of the office-based doctors who participated used an electronic medical-record system. Critics said the plan and its aggressive timeline could make it more difficult to use health-care information technology.

David Blumenthal, who heads the Office of the National Coordinator for Health Information Technology, said that he understands concerns about putting health-information technology into practice but that the success of the initiative relies on health-care professionals participating.

"The success of this health [information technology] journey depends on people: people who are passionate about improving patient care, and who are supported in making those improvements," he said in a statement.

Although investing in technology can be a sizable endeavor for medical practices with years of service, Sutaria said, it will benefit patients.

Her business features a retreat room where a patient can relax in an automated massage therapy chair before an appointment or after having pupils dilated. Fruit- and vegetable-based beverages that could help stimulate eye health are offered.

By using a digital-refraction system, a device that measures prescriptions for eyeglasses or contact lenses, that is integrated with a patient's medical information, Sutaria said, she is able to compare the effectiveness of a prescription and change it, if necessary, without significant delay.

The device is controlled by a wireless keypad and can instantly switch between prescriptions and recall a patient's prescription history within seconds. Sutaria said patients notice the difference immediately.

"They're more likely to get that new pair of glasses," she said, because they see better.

Sutaria said the increased efficiency has allowed patients to spend more time with her than waiting for service. She also reduced the errors and delays that stockpiling handwritten documents caused at her former employer's.

"I don't know what it'd be like to go back," she said. "I'd probably hate it."

EMR Consultancy ImplementHIT Positions St.Vincent Health to Achieve Cost Savings & Federal Stimulus Incentives - June 23, 2010

Pediatricians Commonly Misdiagnose Kids - June 23, 2010

WebMD Health NewsReviewed by Laura J. Martin, MDJune 23, 2010 -- Just over half of pediatricians responding to an anonymous survey acknowledged making at least one diagnostic error a month, and just under half said that at least once a year they made errors that harmed patients.

The survey involved 726 academic and community-based pediatricians or pediatric residents practicing in Houston or Cincinnati.

Diagnosing viral illness as bacterial infection was the most commonly reported diagnostic error, closely followed by failure to recognize the side effects of medication.

In all, 55% of the pediatric residents, 48% of the pediatricians working at academic centers, and 53% of community-based pediatricians reported that they had misdiagnosed viral illness as bacterial infection.

Antibiotics are useless for the treatment of colds, flu, or other viral infections, yet they are widely prescribed. The CDC and other health groups identify antibiotic overuse as one of the most significant public health problems.

“Prescribing antibiotics when they are not needed increases the risk for antibiotic resistance and it puts patients at risk for side effects,” Baylor College of Medicine pediatrician and study co-author Geeta Singhal, MD, tells WebMD.

Study First to Explore Misdiagnosis in Kids
Published in the July issue of the journal Pediatrics, the study is among the first to explore the frequency, types, and causes of diagnostic errors in pediatric practice.

Slightly more than half of the academic center pediatricians and pediatric residents who responded to the survey reported misdiagnosing side effects of medicines taken by their young patients.

Singhal says adverse reactions to certain cough syrups and antihistamines are commonly misdiagnosed.

For example, first-generation antihistamines like the drugs Dimetapp and Benadryl typically make children sleepy, but they might have the opposite effect in children under age 2. Antihistamine-related hyper behavior in a very young child is often misdiagnosed, Singhal says.

Other key findings from the survey included:

When asked to identify the reasons for diagnostic process errors, about half of the doctors (48%) cited a lack of information of the patient’s medical history or failure to review medical charts.
Just over 40% said failure by the parent or caregiver to seek medical attention in a timely manner contributed to the diagnostic error and 39% cited failure to follow up on abnormal diagnostic lab tests.
The pediatricians and pediatric residents cited better access to electronic health records and closer follow-up of patients after initial treatment as strategies most likely to reduce diagnostic errors in pediatric practice.


Electronic Records: ‘No Silver Bullet’
Study co-investigator Hardeep Singh, MD, MPH, says electronic medical records will help address the lack of coordination among medical providers, which is a major contributor to misdiagnosis in both general and pediatric medicine.

Johns Hopkins University Medical School neurologist David Newman-Toker, MD, PhD, who has studied diagnostic errors, agrees. But he tells WebMD that much more is needed.

“It is clear to me after studying this issue that there is not going to be a single silver bullet that does away with diagnostic errors,” he says. “We will need multifaceted interventions to tackle the problem.”

Newman-Toker says it is no big surprise that the diagnostic errors are common in pediatric medicine, just as they are in general medicine.

In a commentary published in the Journal of the American Medical Association last year, Newman-Toker and Johns Hopkins colleague Peter J. Pronovost, MD, PhD, write that diagnostic errors result in as many as 40,000 to 80,000 hospital deaths each year in the United States.

“I would think the risk of a fatal misdiagnosis is lower in children, because children have far fewer life-threatening medical conditions,” he says.

He adds that parents or caregivers who think their child’s illness has been misdiagnosed should never hesitate to discuss their concerns with the child’s physician.

Singh and Singhal agree.

“Families and caregivers know their children best,” Singhal says. “If they don’t understand the diagnosis or have concerns, it is important to talk to the pediatrician.”

Look, No Hands! The “Dragon Dictation” App on the IPad - June 22, 2010

The Apple corporation is once more making its way to the front of the crowded technology market with such innovative products as the iPad. This most unique device, allows users to access the most user friendly interface currently on the market. Although most buyers are using this unit to access news and informational services — such as NPR and USA Today, there are additional applications (apps) that have recently surfaced, designed to make this experience all encompassing. A great example of this is the Dragon Dictation program offered by the Nuance group for the iPad. It requires a wireless connection to the internet (WiFi or 3G are preferred) in order to function properly.

This app will transcribe the human voice directly to text. This is perfect for those persons who are required to send long email messages and aren’t at a full sized keyboard to complete this activity. Instead, the Dragon Dictation software will take the spoken words and translate those into text on the screen. It is great for emails or documents that are lengthy in nature. There is no typing involved at the outset (although corrections later may need some), with only the human voice used as the input.

It is very easy to get started on this process. Make sure that you are connected to the internet and in a quiet place. This will avoid the possibility of disturbing others and reduce the amount of noise that is “heard” by the microphone. Put on the headset and then power up the iPad and open Dragon Dictation. There will be a large recording button on the screen that needs to be tapped. This will start the dictation. The program will automatically transcribe the spoken words at the Nuances server location. Once finished, simply tap the record button again to stop the transcription.

The biggest problem that most users have with this app is learning how to speak properly for the computer. For a normal human voice, the brain is trained to filter out most of the filler parts of speech to make sense of the words spoken by another. This is not the case for a machine, which does not have the mental acuity enjoyed by most humans. Words to avoid such as “uhs”, “ums” and “ers” take practice and aren’t always easy to overcome for many people. It is certainly possible with practice to be able to voice-type 40 words per minute. But this takes time, so training your voice is certainly something to think about.

Once the transcription session is complete, it is then possible to review the text before actually sending off the document or email. Many words can automatically be fixed by the built in dictionary/thesaurus which gives the user the option of using a selected group of words instead of the one selected. At times, however, the correction won’t already be loaded and a manual fix has to be done. Using the keyboard on the unit, the selected word can be highlighted and deleted or simply fixed. Either way, users are able to revise and edit the message before copying and pasting into an email message.

Of course there are other uses for this application. Business users of course favor the ease of composing long strings of texts without the cumbersome use of the tiny keyboard. But online entrepreneurs and social marketing mavens use this handy device to send out updates to their social networks, including facebook, twitter and myspace. It is a great use of a new technology to keep in touch with the many friends on the virtual online community. You will be impressed once the voice training period is over and this program runs so efficiently for the needs of most user.

About the only complaint that purchasers have made is the size of the record button after the app is started. Recall that by tapping the screen on this icon, recording was initiated and stopped. At the outset, it was very large and easy to spot. However, once the program is running, it appears as a tiny spot at the top of the text page. Users found this much harder to navigate and sometimes the first paragraph of the text was disrupted because the cursor found its way into this area, instead of stopping the app itself.

The only other drawback is the inability of desktop users of dragon dictation to train this version. At this point in time, it will take voice training before the full effects can be felt. This appears to be a small price to pay for such a handy item. Professionals enjoy the ease of use that it provides, allowing them to free up some more time to devote to their work. Since maintaining contact with associates is so important in this age of information exchange, the Dragon Dictation can really help with this problem. Most of all, by allowing clients to speak, instead of type, the documents created will most likely be completed a whole lot faster.

This is one application that seems to be a perfect fit for the hardware it was designed for. Most buyers seem to think that with a few minor software adjustments, it will be an essential part of any business kit. The Apple corporation seems to have hit another home run with the iPad.
