CMS to integrate PQRI, EHR meaningful use programs - July 5, 2010

The Centers for Medicare & Medicaid Services (CMS) filed a proposed rule last week addressing changes to the Medicare Part B physician payment fee schedule for calendar year 2011, including the integration of Physician Quality Reporting Initiative (PQRI) and the EMR incentive program.

The Patient Protection and Affordable Care Act of 2010 requires CMS, by no later than Jan. 1, 2012, to develop a plan to integrate reporting on quality measures under PQRI with reporting requirements relating to the meaningful use of EHRs under the American Recovery and Reinvestment Act of 2009 (ARRA).

“In an effort to align PQRI with the EHR incentive program, we propose to include many ARRA core clinical quality measures in the PQRI program, to demonstrate meaningful use of EHR and quality of care furnished to individuals,” stated the proposed rule, filed on June 25. “We propose the selection of these measures to meet the requirements of planning the integration of PQRI and EHR reporting.”

The proposed rule is expected to be published in the Federal Register on July 13, according to the organization, and is currently available in the Federal Register’s Public Inspection Desk for public comment. Comments will be accepted for 60 days after the date of filing for public inspection at the Office of the Federal Register.

CMS to Publish “Meaningful Use” Final Rule by July 14 - July 5, 2010

According to a report on FierceEMR.com, the CMS has announced that by July 14 it will release its final ruling on the EMR “meaningful use” standards which will finally spell out just how healthcare providers can become eligible for the HITECH (Healthcare Information for Electronic and Clinical Health) Act financial incentive payments.

In addition, it will presumably unveil its plan for aligning its Physician Quality Reporting Initiative (PQRI) with the EMR financial incentives program.

“We propose to include many ARRA core clinical quality measures in the PQRI program, to demonstrate meaningful use of EHR and quality of care furnished to individuals,” CMS states in an advanced copy of the proposed reg, CMIO magazine reports. “We propose the selection of these measures to meet the requirements of planning the integration of PQRI and EHR reporting.”

CHIME: EHR certification criteria could change with time - July 5, 2010

The government’s certification program for health IT will continue to evolve over time, according to a review of the recently released final rule for the temporary certification program, released last week by the College of Health Information Management Executives (CHIME).

The temporary program to certify EHR technology went into effect on June 24, and it will be replaced by the permanent certification program as soon as Dec. 31, 2011. However, CHIME found that the recently released final rule suggests that EHR will need to be certified on an ongoing basis, and that meaningful use criteria are likely to evolve over time.

“Regardless of the year and meaningful use stage at which an eligible professional or eligible hospital enters the Medicare or Medicaid EHR Incentive Program, the certified EHR technology that they would need to use would have to include the capabilities necessary to meet the most current certification criteria,” according to the temporary certification rule.

While the industry is uncertain about the final shape of the meaningful use objectives that Centers for Medicare & Medicaid Services (CMS) will choose, the temporary certification final rule suggests that Stage 1 criteria could become tougher over time, the Ann Arbor, Mich.-based CHIME stated.

CHIME’s interpretation of the rule suggests that, although Stage 1 criteria will be finalized soon, it is possible future rule-making could include updates to the Stage 1 criteria, said Pamela McNutt, senior vice president and CIO at Dallas-based Methodist Health System and chair of CHIME’s Policy Steering Committee.

The final rules for temporary certification don’t require recertification for HIT product updates and “fixes” that don’t adversely affect meaningful use criteria. However, a product may be certified if there are any concerns about changes in an application that could affect its ability to achieve meaningful use objectives.

In addition, the authorized testing and certification bodies (ATCBs) recognized by the Office of the National Coordinator for Health IT (ONC) cannot require that integrated bundled EHRs or EHR modules be certified to a higher set of standards than the certification criteria set by the ONC. CHIME viewed this clarification as a positive result of the commenting process that caused ONC to re-evaluate the proposed rule.

CHIME also positively viewed provisions in the final regulation that call for ATCBs to provide remote testing of applications. The regulations state that an application need not be live at a customer’s site before it is tested, opening the way for testing of applications at vendors’ facilities.

The organization still is concerned that a product’s certification can be revoked for some “Type 1” violations by an ATCB that would prompt questions about the integrity of the certification of those products. If a product loses certification, a healthcare organization would have 120 days to secure a certified product, either by the vendor having its product re-certified by a different ATCB or installing another certified product.

While the loss of a product’s certification is unlikely, any such occurrence will probably affect hundreds of provider organizations and could place them under extreme stress to resolve the issue quickly, CHIME said.

Health IT panel scrutinizes 2013 quality measures - July 5, 2010

Even before healthcare providers begin to demonstrate the first set of meaningful use requirements next year, federal health IT policymakers are already working on how high to set the bar for providers to qualify for the next round of financial incentives payments in 2013.

One set of criteria – that providers show the use of health IT to healthcare quality outcomes – will appear in progressively more sophisticated stages. A tenet of meaningful use, quality measures are expected ultimately to help providers both hone their treatment protocols and lower healthcare costs.

The National Quality Forum (NQF), a performance improvement organization, is currently looking at several sources of quality data from which to identify categories of measurement and to weigh the readiness of providers to them into widespread use.

The results of the “fast track” NQF project will help inform discussions by the federal Health IT Policy and Standards committees when they take up future quality measures in September, according to Janet Corrigan, chairman of the Health IT Standards Committee clinical quality work group and the chief executive of NFQ.

“As we look to 2013 and 2015, ideally we would want to look across the full longitudinal care episodes,” said Corrigan. “In 2011, all our measures are siloed and not across settings,” she said at a standards committee meeting June 30.

For instance, providers should not only look at readmissions in their own facility but across the community and patient outcomes and total cost of care over six months or 12 months, she said.

By showing how they track selected meaningful use quality measures to improve outcomes, such as measuring the reduction in hypertension through periodic blood pressure testing, providers will qualify for incentive payments under the HITECH Act.

To gauge what types of future measures may be more useful than others, NQF is combing through comments that the public made in response to the proposed meaningful use rule from the Centers for Medicare and Medicaid Services.

Beacon Communities have also started to assemble a list of measures that focus on particular conditions, such as diabetes, “which all the communities have identified as one they want to push on,” Corrigan said.

The Office of the National Coordinator awarded grants to 15 communities around the country where adoption of electronic health records is substantially underway and can serve as models for other locales.

NQF also has conducted a survey of the quality measures that nine healthcare systems, including Geisinger Health System and Mayo Clinic, monitor. In addition to measures tracking diabetes, hypertension and obesity, which are already included in the proposed 2011 meaningful use measures, these health systems are highlighting measures to reduce hospital-based infections and enhance patient safety and accurate medication management, she said.

NQF also has sponsored a discussion group, called the Gretsky Group, named after the ice hockey great Wayne Gretsky, “to think about where the puck is going in 2015 and then work back to 2013 measures,” Corrigan said.

Recently, one of the pharmaceutical companies with which Dr. Eczema works contacted his research nurse to ask her to provide the company with a copy of all of this electronic data. The company wants to use this data to develop better treatments for atopic dermatitis. Trying to be helpful, the nurse gives the pharmaceutical company all of the data in question.

Not long after, one of Dr. Eczema's other employees finds out about this transfer of data. Because of her ill feelings toward her fellow employee, she tells some friends about what has occurred. One of these friends is a former research patient in Dr. Eczema's office, and she is furious at this breach of her medical privacy. She hires an attorney who reaches out to Dr. Eczema. The attorney tells Dr. Eczema that he will sue him for a HIPAA violation unless he settles with his client for $100,000. Should Dr. Eczema settle this case? Should he pay the $100,000?

EMR is here to stay. In spite of all the benefits offered by electronic medical records, their use has also introduced a number of problems and issues. Perhaps the most important of these are the potential privacy breaches associated with electronic record and data storage. As more personal information, such as school records, credit card information and bank account data goes online and is stored electronically, people seem to have become more accustomed to accepting the risks associated with storing personal data this way, especially in view of the convenience and other benefits that this method offers. Medical records, however, are possibly the most private and personal information available about a person, and therefore are subject to unique privacy and security concerns.

While breaches of other personal data are intrusive and potentially harmful, medical records are unique by their very nature. Once private medical information is breached, it is nearly impossible to mitigate the potentially associated harm.

In view of these concerns, Congress passed the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its associated regulations. Under HIPAA, the Department of Health and Human Services (HHS) has the authority to adopt standards for HIPAA-specified entities to follow in protecting, using and disclosing patients' medical information and records. In the act, Congress listed the following parties as covered entities subject to the HHS-adopted standards: health plans, healthcare clearinghouses, and healthcare providers who transmit any health information in electronic form in connection with specified financial and administrative transactions.

Using its congressionally delegated authority, HHS enacted regulations commonly referred to collectively as the "Privacy Rule," which took effect April 14, 2003. This rule established specific obligations for covered entities regarding the safekeeping and privacy of protected health information.

The Privacy Rule defines protected health information (PHI) as medical information that is "individually identifiable" as pertaining to a specific patient. Individually identifiable information includes health information that is maintained in any form or medium; relates to, identifies or could identify the person that the health information concerns; and is transmitted or maintained by a covered entity. More specifically, the Privacy Rule covers information that a patient's doctors, nurses and other healthcare providers put in his/her medical record; conversations a doctor has about a patient's care or treatment with nurses and others; information about a patient in his health insurer's computer system; billing information about a patient at his/her office; and most other health information about a patient that is held by covered entities.

The Impact of Recent HIPAA Changes - July 5, 2010

The Health Information Technology for Economic and Clinical Health (HITECH) Act, part of the American Recovery and Reinvestment Act of 2009, contains a number of changes to the regulations of the Health Insurance Portability and Accountability Act (HIPAA). To remain HIPAA-compliant, speech-language pathologists and audiologists who are "covered entities" (health care providers who conduct certain financial and administrative transactions electronically) should be aware of several HIPAA changes now in effect.

Security Breach Notifications
A covered entity must notify affected individuals following the discovery of a breach of unsecured protected health information (PHI). If a covered entity discovers a breach, it must provide written notice to the individual without "unreasonable delay" and within 60 days after the discovery of the breach. A business associate must follow the same timeline to notify the covered entity when it discovers a breach. Right to Request PHI Restriction
Under HIPAA, an individual has the right to request that the covered entity restrict the use and disclosure of his or her PHI for treatment, payment, or health care operations. Prior to the HITECH Act provisions, a covered entity did not have to agree to a restriction; now, however, if an individual pays for a service out-of-pocket, the covered entity must grant the individual's request for restrictions on the use and disclosure of PHI related to that service for payment or health care operations.

Business Associates
The HIPAA security standards that apply to covered entities also now apply to business associates (individuals or corporations that perform any function involving the use or disclosure of PHI on behalf of the covered entity and are not a member of the covered entity's workforce). Previously, business associates were liable for breach of contract only if they did not comply with certain security requirements included in the business associate agreement. Now, business associates are required to comply with the HIPAA security standards and are subject to the same criminal and civil penalties that apply to covered entities if they do not. These new requirements must be added to the business associate agreement.

Business associates also are required to comply with the privacy obligations outlined in the business associate agreement. If a business associate violates those privacy provisions, the business associate is not only liable for a breach of contract, but also is subject to civil and criminal penalties.

Finally, if a business associate becomes aware that the covered entity has breached its obligations under the business associate agreement, the business associate must take steps to cure the breach. If this is not possible, the business associate must then either terminate the agreement or report the covered entity to the Department of Health and Human Services. (The covered entity already has the same obligation regarding a business associate's breach of the agreement.) The business associate agreement should be amended to reflect this new obligation.
