Guest Post: Scanning Paper Charts in an EMR Office - July 7, 2010

One of EMR and HIPAA readers, John Meewes, was reading some of the comments on my previous post, “Paper Chart Disposal After Implementing an EMR” and wanted to provide a scanning companies perspective on what he’s seeing in the market. The following is his guest blog post on the subject.
Discretionary scanning, hiring temporary help, and re-purposing office
staff to scan patient charts has been a growing trend.
While the costs associated with these practices may at first glance seem
lower, there are hidden costs and liabilities that far outweigh the
expected savings.
When selecting a scanner, the first number potential buyers see is the
“Pages per Minute” (ppm). This is the number of sheets that the scanner
can read under optimum conditions (and usually at lower resolution and
page size). The number usually not published or ignored is the daily
duty cycle – often just several thousand pages per day.
In real world settings, the actual throughput is less than 1/4 of the
published PPM. Jams, indexing, and software glitches all slow the
process. Equipment maintenance, software installation, training, and
employee turnover further add to the time spent on the scanning project.
As labor costs (which are a function of throughput) increase fourfold or
more, the ROI model that may have initially shown cost savings with a
“do it yourself” project may no longer support that decision.
Most importantly, though, is the liability physicians face for
improperly scanned charts. Transient help is cheap, but they have no
responsibility to monitor quality, ensure that records are properly
filed & attached to EMR, or to ensure that misplaced records are found.
We even worked with a physician who had temporary help literally
throwing charts away to create the illusion of higher productivity.
Physicians are required by law to maintain a medical record for each
patient which completely and accurately documents the person’s
evaluation and treatment. The failure to maintain a record for each
patient constitutes professional misconduct. A missing chart could
have serious consequences on the provider’s ability to defend themselves
in a malpractice claim. If you can’t produce the documentation, then
your version of the events will be suspect.

ensure accurate and complete conversion of paper charts. While the
upfront costs may seem higher, the peace of mind and longer term savings
are worthy of consideration.

New Rule Allows for Electronic Transmission of Controlled Substance Prescriptions - July 5, 2010

A new Drug Enforcement Agency (DEA) rule could substantially impact the way prescriptions for controlled substances can be transmitted from a physician to a pharmacy. As physicians and pharmacies seek to cut costs and maximize efficiency, electronic record keeping and prescription filing has become more commonplace. In response, the DEA has relaxed previous restrictions on electronically filing controlled substance prescriptions. However, recognizing the high risks posed by abusing or forging controlled substance prescriptions, the DEA has created a system of requirements which must be met before a physician is able to take advantage of the new rule.
The DEA defines controlled substances as drugs and other substances that have a potential for abuse and psychological and physical dependence; these include opioids, stimulants, depressants, hallucinogens, anabolic steroids, and drugs that are immediate precursors of these classes of substances. Once classified as a controlled substance, drugs are then broken down into one of five categories depending on the potential for abuse and risk of dependance. Today, controlled substances account for between 11% and 12% of prescriptions written in the United States.
Under the previous rule, physicians were prohibited from electronically sending prescriptions for schedule II-V controlled substances to pharmacies. However, under the current rule, which was published March 31, 2010 in the Federal Register, physicians who meet certain requirements will be permitted to e-file those prescriptions beginning June 1, 2010. To be eligible to e-file controlled substance prescriptions, physicians must meet two of three factors. The “two-factor authentication protocol,” which seek to guard against fraudulent prescription filings by confirming the prescribers true identity includes:
1.A password or PIN number,
2.biometric data- either a fingerprint or iris scan, or
3.a “hard token”- a secured device separate from a computer that can provide a password to a physician at the time of e-filing.
To be eligible to e-file controlled substance prescriptions, physicians must validate their identity with a designated agency. When applying for the proper credentials to utilize e-filing programs, physicians must supply verifiable information such as government issued identification or financial account information.
Currently, Michigan laws vaguely address the current state of e-filing prescriptions for controlled substances. MCL 333.7333(7) states that physicians may electronically transmit prescriptions as long as they do not conflict with federal law. The law does not differentiate between controlled substance and non-controlled substance prescriptions. As a result, we may see future clarification from the Michigan legislature or the Board of Pharmacy regarding this issue. Importantly, physicians and pharmacies that currently possess the technology to e-file prescriptions must ensure that their systems comply with the new DEA “two-factor authentication protocol” requirements for controlled substances. Licensed physicians who cannot afford to implement the required technology or simply wish to opt out of the program are still able to produce physical prescriptions which can be presented at a pharmacy.

CMS OKs Updated E-Script Standard - July 5, 2010

The Centers for Medicare and Medicaid Services has "recognized," or approved, the use of an updated standard for electronic prescribing under the Medicare Part D drug benefit program. Clinicians now can use version 10.6 of the National Council for Prescription Drug Programs SCRIPT Standard to prescribe electronically.
Version 10.6 is backward compatible with version 8.1, which CMS previously adopted as a national standard. This means that prescribers can continue to use version 8.1 or migrate to 10.1.
In a final interim rule with comment period, CMS explains that "recognition" means version 10.6 can be used but is not yet formally adopted as the new electronic prescription standard. "We anticipate proposing the adoption of NCPDP SCRIPT 10.6 as an adopted standard at a later date in a further notice of proposed rulemaking. At that time, we would propose to adopt NCPDP SCRIPT 10.6 and retire the current adopted standard."
New functions in version 10.6 will enable users to provide prescriber order numbers, drug NDC source information, pharmacy prescription fill numbers and date of sale information that also could be used in a medication history response transaction, according to CMS. "These added functionalities would therefore be expected to facilitate better record matching, the identification and elimination of duplicate records, and the provision of richer information to the prescriber between willing trading partners."
CMS expects to publish the interim final rule on July 1. It is available in a non-final format now at the Federal Register's Public Inspection Desk at federalregister.gov/inspection.aspx.

Why do we need "meaningful use"? Why do we need further reform of our healthcare system, not just the charade of insurance reform masking some actual elements of care improvement that the Patient Protection and Affordable Care Act gave us?
The Commonwealth Fund answered those questions last week when it released its latest report on health system performance. "Compared with six other nations--Australia, Canada, Germany, the Netherlands, New Zealand, and the United Kingdom--the U.S. healthcare system ranks last or next-to-last on five dimensions of a high performance health system: quality, access, efficiency, equity, and healthy lives," reads the report overview.
I can't take seriously the claims by some pundits and politicians that the United States has "the best healthcare in the world," because it's clear that we don't. Even though many consumers equate more care with better care, those of us that work in or closely follow the healthcare industry know better. It's an inefficient system that rewards volume over quality and doctors' ability to remember things on the spot rather than consult tools like clinical decision support.
"With enactment of the Affordable Care Act, however, we have entered a new era in American healthcare," says Karen Davis, Commonwealth Fund president and the study's lead author. "We will begin strengthening primary care and investing in health information technology and quality improvement, ensuring that all Americans can obtain access to high quality, efficient healthcare."
Maybe. The Affordable Care Act does focus on primary care and, by expanding the pool of insured Americans, does address the problems of access and equity. But the reasons to invest in IT came earlier.
There's the 2009 American Recovery and Reinvestment Act, the law that coined the phrase "meaningful use." Going back to 1996, we have the Health Insurance Portability and Accountability Act. HIPAA, of course, was supposed to streamline administrative functions by standardizing transactions. But regulations that allowed each payer to have its own addenda to code sets have largely defeated that intention.
The upcoming transition to ANSI X12 5010 coding from the current version 4010A1 promises to remedy this problem, but we'll see. Let's just not delude ourselves into thinking that the Affordable Care Act is going to fix American healthcare. Your work in moving to EMRs, clinical decision support, quality reporting and standardized coding will do far more than simply adding millions of people to the insurance pool and throwing around a few bucks for primary care. CMS To Integrate PQRI With 'Meaningful Use' EHR Incentive Program - July 5, 2010

In a proposed rule released last week, CMS took the first step toward integrating quality reporting measures under the Physician Quality Reporting Initiative and the "meaningful use" incentive program, Health Data Management reports.
The new health reform law requires CMS to develop a plan for integrating the two programs by Jan. 1, 2012 (Goedert, Health Data Management, 6/28).
The PQRI initiative, launched in 2007, provides incentives to physicians participating in Medicare who report certain quality measures (Simmons, HealthLeaders Media, 6/29). Meanwhile, the 2009 federal stimulus package provides Medicare and Medicaid incentive payments to health care providers who demonstrate meaningful use of electronic health records.
In a proposed rule about Medicare physician payment changes for 2011, CMS requested public comment on how it should integrate the PQRI and meaningful use incentive programs. CMS plans to publish a final version of the proposed rule on July 13.
According to CMS, meaningful use measures that physicians could use for PQRI reporting through EHRs include:
•Blood pressure management;
•Body mass index screening;
•Prevention care follow up; and
•Prescription drugs that should be avoided for elderly patients (Mosquera, Government Health IT, 6/28).

Medical Imaging Could Be Revolutionized by iPad - July 5, 2010

Experts in the medical community are excited about how Apple’s iPad could be used in a medical capacity to streamline the medical imaging process. In June, Japanese doctors pioneered the use of iPad as an imaging assistant during surgery, but practical uses could go even deeper.
“iPads can theoretically contain the entire electronic record of the patient’s imaging experience, and can be handed along the workflow as needed,” said Paul Merrild, senior VP of marketing and business development at imaging IT vendor Merge Healthcare. “At the end, the iPad has potential to provide a nice teaching and communication tool between the radiologist, referring physician and the patient.”
For doctors, the iPad could make a big difference in the process of reviewing images, going over reports and medical records, and helping to explain to patients the extent of their illness with a helpful visual guide. The long battery life, the always-on nature of the device, and the high-quality screen are what endear the iPad to doctors over similar devices in the product category.
While the iPad excels in certain everyday uses for radiologists, the hardware isn’t developed enough for them to use it to replace the displays they currently use to make diagnoses. The brightness of the iPad display is still a fraction of what radiologists’ primary interpretation displays can handle, and the screen still isn’t up to the resolution standards radiologists would need to replace their current hardware.
More importantly, the iPad does not provide enough security to comply with HIPAA regulations regarding patient privacy. Hospital IT departments are reportedly already hard at work devising ways that patients’ medical information could be stored on a remote web server and streamed to an iPad as needed.
“So, the iPad will need some software changes to find a niche in healthcare, because it will need to be a locked-down, tightly controlled IT asset accessible safely by multiple users — in that regard, it’s not there yet,” said Robert Taylor, president and CEO of TeraRecon, an advanced visualization vendor.
The benefits of using the iPad in this capacity are clear, making it just a matter of ironing out the kinks. Don’t be surprised then if you walk into a hospital in a few years and find it full of iPad-toting doctors.

HIPAA encryption: meeting today's regulations - July 5, 2010

There are a couple of reasons for this increased focus on encryption.
First, the U.S. Department of the Health and Human Services (HHS) issued guidance wherein "unsecure protected health information (PHI)" is essentially any PHI that is not encrypted or destroyed. Under this definition, it doesn't matter how many chains, walls, doors, biometric gizmos and guards with lethal weapons you have at your service. As long as PHI is not encrypted, it is considered unsecured.
A second and more compelling reason why encryption is now a requirement is the introduction of HITECH's breach notification initiative, which requires HIPAA-covered entities to send notification letters if there is a breach of unsecured PHI. However, as HHS pointed out, the use of encryption grants safe harbor in the event of a breach because encrypted PHI is not unsecured PHI.
Oddly enough, in the same breath, HHS also notes that "covered entities and business associates are not required to follow the guidance." However, cleaning up the mess behind a breach notification can cost millions of dollars, so one would have to be supremely confident — or reckless — in not taking advantage of the encryption safe harbor. With such mixed signals, though, it is not hard to see why encryption is called a de facto requirement.
What type of encryption?
Since encryption means different things to different people, an important question is "what type of encryption should I use?"
In the past, companies offered hard drives that used strong encryption. However, analysis showed that strong encryption was used but only to protect the password and not the data that was stored on the devices. The actual data stored on the hard drive was encrypted with an encryption algorithm developed by the company, which proved to be anything but strong.
This illustrates the potential pitfalls of choosing any type of encryption package — a lack of strong, secure encryption. Obviously, some encryption programs do a better job of protecting data than others, but how can a company choose the right one?
HHS does not provide any guidance in this area, and that is a smart move. HHS does many things, but it is not in the position to determine the technical requirements that would separate strong from weak encryption. Instead, HHS defers to the National Institute of Standards and Technology (NIST) to direct organizations to a number of special publications on the subject.
The publications are endless, tedious documents which are long on theory and short on technical requirements. However, a little detective work leads to concrete specifications that one can work with.
While these requirements are for federal agencies, they could also serve as a great guide for private practices. Since HHS deferred to NIST when it comes to encryption, companies need to meet the expectations of what NIST considers "proper" encryption for sensitive data.
Further proof that HHS deferred to NIST is found in the guidance, where encryption for "data at rest" and "data in motion" are specifically mentioned. The latter refers to data going through networks, including wireless networks. The former refers to data that is stored: laptops, external hard drives, CDs or DVDs, backup tapes, etc.
Data in motion
Of the two, encrypting data in motion is more straightforward: Valid encryption processes must "comply with the requirements of Federal Information Processing Standards (FIPS) 140–2." While there are many technical requirements involved, many vendors offer products that are FIPS 140-2 validated, so finding such a solution is easy.
Organizations must look for a solution that is FIPS140-2 validated, not FIPS140-2 certified. The former means that NIST evaluated, and validated, the encryption. The latter is used interchangeably with the former, but is technically meaningless and is mostly marketing speak. While encryption is in the spirit of NIST's requirements, it hasn't been validated.
Data at rest
Finding appropriate data at rest encryption requires a little digging. According to the suggested NIST publication — Special Publication 800–111, Guide to Storage Encryption Technologies for End User Devices — "Federal agencies must use FIPS-approved algorithms contained in validated cryptographic modules. Whenever possible, AES (Advanced Encryption Standard) should be used for the encryption algorithm because of its strength and speed."
Also, a footnote makes reference to NIST SP 800-57, "Recommendation for Key Management," and notes that it "provides detailed information on key management planning, algorithm selection and appropriate key sizes, cryptographic policy and cryptographic module selection."
This information is relegated to a footnote. This is unfortunate since this publication is what most HIPAA-covered entities are looking for. As organizations review section 5.6.2 of the publication, they can identify encryption algorithms that are valid for use, the minimum key sizes and the length of their validity. In addition, examples are given on how all of the above comes together, and summarized in a table. Any encryption weaker than this, and you might not be covered.
HIPAA-covered entities can expect safe harbor if, and only if, they adhere to these strict standards and guidelines. The fact that a company's data is encrypted is meaningless without taking into account the NIST requirements. Organizations that properly adhere to HIPAA standards understand the impact of breach notifications. By proactively leveraging the proper encryption technologies, companies of all sizes can avoid these breach notifications while ensuring the security of their sensitive data.

Health IT Study: Meaningful Use Separates ‘Haves’ from ‘Have-Nots’ - July 5, 2010

The Health Information Technology for Economic and Clinical Health Act, signed by President Barack Obama in 2009, is ready to hand out $36 billion in incentive payments to providers who implement EHR systems – as long as they comply with a new set of regulatory metrics called meaningful use.
A recent study by PricewaterhouseCoopers’ Health Research Institute found some health systems are finding it difficult to achieve meaningful use requirements, but the benefits of achieving it heavily outweigh the challenges.
According to the study, which surveyed 120 CIOs and health IT executives, the requirements of meaningful use of EHRs are vital in ensuring the new IT systems are effective and systematic. It states that leveraging meaningful use could potentially “create strategic opportunities, align with physicians and health insurers, and engage and empower patients.”
While all providers do not need to fall under the meaningful-use requirements, the ones that do receive government funding. The analyses demonstrated, “A typical 500-bed hospital demonstrating MU by 2011 could receive more than $6 million in Medicare incentive payments, and individual physicians could receive up to $44,000.”
However, the survey showed a common set of barriers that are keeping CIOs from achieving meaningful-use requirements. The four obstacles health systems face on the road to meaningful use are the lack of clarity on meaningful use standards, the shortage of skilled staff, vendor readiness, and questionable existing infrastructure capabilities.
“Even though the incentives represent the government’s largest investment in health IT, only half of hospital CIOs surveyed by PwC said they would be ready to apply for those incentives in 2011, the first year they become available,” the researchers reported. “One reason is that many hospitals are too far behind the curve.”
The researchers presented five “mile markers” to guide health systems in marking their progress on the road to meaningful use. These mile markers include: the establishment of governance of meaningful use achievement, the balancing of competing priorities of time lines, making new public-private partnerships, making the patient the purpose and collaboration between physicians and health insurers.
Their findings revealed that without these alignments, organizations may not be able to keep up with IT changes. They will ultimately be absorbed by “those who can.” Through this transformational effort, the way the health system delivers care will be drastically changed.
“MU will separate the haves and have-nots. Those organizations that survive will achieve alignment in strategy, quality, the physician community, and finances,” said Daniel Morreale, vice president of regional health information organization development at AtlantiCare. “The others will fall by the wayside due to poor quality, inability to engage physicians, and inadequate finances.”

CMS Unveils New Website on ‘Meaningful Use’ Incentives - July 5, 2010

Last Monday, CMS launched a new website intended to help health care providers better understand the criteria to meet federal requirements for the “meaningful use” of electronic health record systems, Government Health IT reports.
Under the 2009 federal economic stimulus package, health care providers who demonstrate meaningful use of EHRs will qualify for Medicare and Medicaid incentive payments (Mosquera, Government Health IT, 6/21).
Website visitors can download fact sheets detailing the proposed program requirements and the proposed definition of meaningful use.
The site also clarifies various terms, such as “eligible professional” and “certification,” that are included in the HITECH Act (McKinney, Modern Healthcare, 6/21).
In addition, the site includes:
An overview of the incentive program;
Information about what health care providers are eligible for incentive payments;
Information on how to register for the program; and
Guidance on what health care providers can do to prepare for meaningful use.
CMS also said that it would use the website to publicize EHR training and events related to the incentive program (Government Health IT, 6/21).
According to Modern Healthcare, the website will offer more specific information about the incentive eligibility requirements after CMS issues the final rule on the EHR incentive programs later this summer (Modern Healthcare, 6/21).
